Regime geral da previdência social - RGPS : fatores que contribuem para o déficit do RGPS

Abstract

O presente trabalho trata do Regime Geral de Previdência Social - RGPS e de alguns fatores que contribuem para o seu déficit, sobretudo o caráter assistencialista do regime. O RGPS é a segurança que os trabalhadores da iniciativa privada e demais filiados do regime têm de que não sofrerão solução de continuidade no recebimento de renda. Assim, poderão manter em dia seus compromissos financeiros e, no caso dos mais pobres, garantir sua subsistência. Cada vez albergando mais segurados, o RGPS cresceu muito, principalmente com o implemento de políticas sociais e assistencialistas, o que causou enorme demanda de gastos para suportar o pagamento de benefícios previdenciários. Nesse contexto, esta obra analisa alguns aspectos do RGPS que influenciam no sentido de aumentar o déficit do regime. A proposição e análise do viés assistencialista e de outras causas do déficit previdenciário foi realizada a partir da pesquisa doutrinária e legal dos diversos conceitos do Direito Previdenciário. Inicialmente, estabeleceu-se a base de conhecimento necessária para que variados leitores – até mesmo sem formação na área de direito – pudessem entender o que são e como funcionam a previdência social e o RGPS. Na sequência, o regime geral foi pormenorizado e, após isso, foram descritos alguns aspectos que contribuem para o déficit do RGPS: o caráter assistencialista do regime (o segurado facultativo e a uniformidade e equivalência dos benefícios destinados às populações urbana e rural), o princípio da insignificância no direito previdenciário, o período de graça e o período de carência.

This paper intends to analyze the General Social Security System and some of the causes that contribute to its deficit, mainly the welfare character of the general system. This welfare system guarantees that private sector workers and other people linked to it will keep receiving the money they need to maintain their financial commitments, and so that the poor may assure their subsistence. As it harbors more and more people, the Social Security General System has greatly increased, especially through the social and welfare policies, which demand a lot more financial outflows to support benefit payments. So, this paper analyzes some aspects of the General System that make the deficit increase. The starting point of this work was a doctrinal and legal research on Social Security. The first step was to create a knowledge basis that would allow even beginners and non law students to understand what welfare is and how the general system works. Next, the general system was detailed and some aspects that increase de deficit were described: the social and welfare character (the optionally insured worker, the equivalence and uniformity of the urban and rural population benefits), the principle of the insignificance in welfare law, and the grace period.
