O trabalho infanto-juvenil no futebol: lei x realidade

Abstract

O objetivo do presente trabalho é demonstrar a realidade em que vivem os menores que possuem o sonho de ser um jogador de futebol. A maioria da população brasileira idealiza essa profissão, desejando que seus filhos façam parte dessa vitrine que é o futebol. Entretanto, tal sonho idealizado não traz consigo os problemas e as dificuldades por quais passam os menores de idade na tentativa de se tornar um craque. É através desse trabalho que pretendemos demonstrar a realidade do trabalho infantil no futebol, tentando desmistificar o mito de todas as crianças que querem se tornar um atleta profissional. Para isso, pretendemos confrontar os aspectos legais e os aspectos reais, demonstrando de um modo simples e direto as leis aplicáveis e a realidade vivida pelos menores. Demonstraremos as leis que regulamentam o trabalho infantil, inclusive as específicas, como Lei Pelé e o Regulamento sobre Status e a Transferência de Jogadores da FIFA, entretanto, nossa ênfase se dará na realidade. Através desse trabalho, poderemos verificar se as leis são devidamente cumpridas e, mais, se elas são suficientes para preservar os menores de uma exploração até então acobertada pelo país de futebol.

The objective of this work is to demonstrate the reality in which minors who have the dream of being a football player live. Most of the Brazilian population idealizes this profession, hoping that their children to be part of this showcase that football is. However, such idealized dream does not bring the problems and the dificulties which minors pass through in an attempt to become a star. It is through this work we intend to demonstrate the reality of child labor in football, trying to desmystify the myth of all children who want to become a professional athlete. To this end, we intend to confront the legal and real aspects, demonstrating in a simple and direct way the applicable rules and the reality experienced by minors. We will demonstrate the rules that regulate the child labor, including the specific ones, such as Pele Law and Regulations on the Status and Transfer of Players of FIFA, however, our emphasis will be given in reality. Through this work, we will be able to verify if the rules are properly fulfilled and, more than that, if they are sufficient to protect minors from an exploration hitherto covered up by the country of football.
