O direito em Aristóteles : uma análise estrutural-funcional

Abstract

A temática central deste trabalho compreende como o direito politiza a vida humana por meio de sua estrutura, a lei, e de sua função, a justiça, segundo a perspectiva de Aristóteles. Justifica se pela relevância do papel do direito como esfera fundamental para estabelecer a lei e a justiça, bem como pela atribuição dos juristas e da comunidade na aplicação desses conceitos no espaço social. O objetivo é demonstrar como a lei e a justiça são essenciais ao projeto aristotélico de politizar a vida em comum. Os objetivos específicos são analisar a estrutura do direito, representada pela lei e observar sua função, que é a promoção da justiça. A metodologia adotada no trabalho é o hipotético-dedutivo. As análises revelam que, ao considerar a natureza política do ser humano, o direito institucionaliza leis racionais em oposição às normas arbitrárias; gerais, ao contrário dos decretos; e coercivas, a fim de promover ações virtuosos e impor penas no caso de violação. Em relação à justiça, essa natureza define na comunidade o justo político, que se manifesta de três formas: justiça geral, ligada ao pertencimento de todos à comunidade e ao dever pelo bem comum; a distributiva, relacionada às interações multilaterais vinculadas à repartição de benefícios e encargos; e a corretiva, associada às relações particulares ligadas aos bens individuais.

The central theme of this study comprises how law politicizes human life through its structure, which is law, and its function, which is justice, according to Aristotle’s perspective. Its relevance lies in the role of law as a fundamental sphere for establishing law and justice, as well as in the responsibility of jurists and the community in applying these concepts within the social space. The aim is to demonstrate how law and justice are essential to Aristotle’s project of politicizing communal life. The specific objectives are to analyze the structure of law, represented by legislation, and to observe its function, which is the promotion of justice. The methodology adopted in this study is hypothetical-deductive. The analyses reveal that, in considering the political nature of human beings, law institutionalizes rational laws as opposed to arbitrary rules, general rather than decrees, and coercive, in order to promote virtuous actions and impose penalties in cases of violation. Regarding justice, this nature defines within the community the notion of political justice, which manifests itself in three forms: general justice, related to the belonging of all to the community and the duty toward the common good; distributive justice, linked to multilateral interactions involving the distribution of benefits and burdens; and corrective justice, associated with particular relationships concerning individual goods.
