Eficácia dos princípios da precaução e da prevenção na proteção da biodiversidade : uma análise do licenciamento ambiental

Abstract

Este trabalho situa-se na área do Direito Ambiental e tem como objetivo estudar os princípios da precaução e da prevenção, bem como a eficácia destes no licenciamento ambiental para a proteção da biodiversidade. Aplicou-se na pesquisa o método dedutivo, partindo dos princípios da precaução e da prevenção, sem prejuízo de outros que atravessassem o tema quando pertinente, para assim analisar o licenciamento ambiental. A técnica de pesquisa adotada foi a bibliográfica e documental, tendo-se utilizado a legislação, doutrinas, obras e artigos relevantes ao escopo do trabalho. Para desenvolver o objetivo proposto, dividiu-se o estudo em dois capítulos. Na etapa inicial, buscou-se investigar e identificar os principais conceitos relativos aos princípios da precaução e da prevenção, bem como o contexto em que se inserem, de forma a permitir uma melhor compreensão de ambos os institutos para posteriormente analisar o tema da biodiversidade. No segundo momento, analisou-se o licenciamento ambiental – com enfoque na licença prévia – em razão de sua relevância na proteção ambiental de forma preventiva. Ao final, buscou-se fazer uma análise crítica do tema de pesquisa. Este estudo confirma a função preventiva do licenciamento ambiental, principalmente da licença prévia. Apesar das limitações técnicas e das pressões a que o instrumento está submetido, o licenciamento ambiental ainda é uma importante ferramenta na efetivação dos princípios da precaução e da prevenção no Direito Ambiental.

This study aims to investigate the principles of precaution and prevention in the field of Environmental Law, as well as their effectiveness in environmental licensing in the protection of biodiversity. The research employed the deductive method, starting with the principles of precaution and prevention, while considering other relevant principles intersecting the theme, to analyze environmental licensing. It also employed bibliographic and documental research techniques, using Brazilian Law, legal doctrines, scholarly works, and articles pertinent to the scope of the study. To achieve the proposed objective, the study was divided into two chapters. Initially, the research sought to investigate and identify the primary concepts related to the principles of precaution and prevention, as well as the context in which they are situated, to enable a better understanding of these institutes and subsequently analyze the theme of biodiversity. In the second phase, the study examined environmental licensing, with a focus on the preliminary license due to its critical role in preventive environmental protection. Finally, a critical analysis of the research topic was conducted. This study confirms the preventive function of environmental licensing, particularly the preliminary license. Despite technical limitations and external pressures on this instrument, environmental licensing remains an essential tool for the implementation of the principles of precaution and prevention in Environmental Law.
