A identificação irregular de suspeitos durante o inquérito policial como fator inicial do erro judiciário : uma análise da jurisprudência do STJ

Abstract

O presente trabalho procura verificar a influência do reconhecimento irregular realizado no inquérito policial em possíveis erros judiciários. Para tanto, irá analisar o ato de reconhecimento de pessoas e seu procedimento formal previsto no Código de Processo Penal e na Resolução 484/2022 do Conselho Nacional de Justiça, abordando a orientação doutrinária e jurisprudencial quanto à sua obrigatoriedade. Também demonstrará a falibilidade do reconhecimento enquanto prova, em razão da influência de falsas memórias e da seletividade do sistema penal. Por fim, para atingir o objetivo pretendido, serão analisados julgados do Superior Tribunal de Justiça, visando verificar como os reconhecimentos são realizados na fase investigatória e o valor atribuído a eles na ação penal.

This paper aims to verify the influence of irregular recognition carried out in the police investigation on possible judicial errors. To this end, we will analyze the act of recognition of persons and its formal procedure provided for in the Code of Criminal Procedure and in Resolution 484/2022 of the National Council of Justice, addressing the doctrinal and jurisprudential guidance regarding its mandatory nature. Also, to demonstrate the fallibility of recognition as evidence due to the influence of false memories and the selectivity of the criminal system. Finally, to achieve the intended objective, the judgments of the Superior Court of Justice will be analyzed, aiming to verify the way in which recognitions are carried out in the investigative phase and the value given to them in the criminal action.
