Aspectos dogmáticos e político-criminais dos crimes de bullying e cyberbullying: lei no 14.811 de 2024

Abstract

Este trabalho tem como objetivo analisar a recente criminalização do bullying e do cyberbullying no Código Penal brasileiro, ocorrida por meio da Lei no 14.811 de 2024, a qual tipificou a intimidação sistemática e a intimidação sistemática virtual. Foram examinados os tipos penais supracitados, a fim de identificar seus elementos, classificá-los de acordo com a Teoria do Delito e apresentar eventuais críticas à sua formulação. Ainda, objetivou-se compreender e compilar outras perspectivas da intimidação sistemática, com a abordagem de aspectos psicológicos, sociais, de outras áreas do Direito e da doutrina estrangeira acerca do fenômeno, para, no fim, deduzir conclusões político-criminais acerca da criminalização da intimidação sistemática. Para isto, foram realizadas análises, respectivamente, dos aspectos psicossociais do bullying escolar, da criminalização da intimidação sistemática em outros países, de aspectos dogmáticos dos crimes de bullying e cyberbullying, e, por fim, de aspectos político-criminais.

This work aims to analyze the recent criminalization of bullying and cyberbullying in the Brazilian Penal Code, which occurred through Law No. 14,811 of 2024, which typified systematic intimidation and systematic virtual intimidation. The aforementioned criminal types were examined in order to identify their elements, classify them according to the Theory of Crime and present any criticisms of their formulation. Furthermore, the aim was to understand and compile other perspectives on systematic intimidation, approaching psychological and social aspects and considerations regarding other areas of Law and foreign doctrine about the phenomenon, to, in the end, deduce political-criminal conclusions about the criminalization of systematic intimidation. To this end, analyzes were carried out, respectively, on the psychosocial aspects of school bullying, the criminalization of systematic intimidation in other countries, dogmatic aspects of bullying and cyberbullying crimes, and, finally, political- criminal aspects.
