A paródia e o pastiche como limitações ao direito autoral aplicadas ao direito marcário

Abstract

A presente investigação dispõe-se a analisar as reais limitações jurídicas ao Direito Autoral, extensivas ao âmbito do Direito Marcário contemporâneo, representadas pelo emprego de certas figuras de linguagem, tais como a Paródia e o Pastiche, de forma a melhor aferir o impacto do uso desses institutos na criação de obras derivadas. Atualmente, muitos deles são configurados em diversos ordenamentos legais como restrições ao Direito Autoral. Mais do que isso, a pesquisa propõe-se a verificar como se manifesta a aplicação dessas limitações quando transpostas para o Direito Marcário. Tal exame exige, não obstante, que o trabalho se movimente na intersecção entre diferentes áreas de conhecimento – Direito Autoral e Direito Marcário, Propriedade industrial, Comunicação, Semiótica – que, transportadas e aplicadas ao objeto da pesquisa, podem auxiliar na busca de respostas mais conclusivas.

The present thesis aims to analyze the real legal exceptions to Copyright Law that can be extended to contemporary Trademark Law and represented by the use of certain figures of speech, such as Parody and Pastiche, in order to better assess the impact of the use of these legal institutes in the creation of derivative works. Currently, many of them are accepted as Copyright exceptions in different legal systems. More than that, the research aims to verify how the application of these exceptions manifests itself when transposed into Trademark Law. This examination requires an intersection between different areas of knowledge – Copyright and Trademark Law, Industrial Property, Communication, and Semiotics – which, when applied to the object of research, can help in the search for more accurate answers.
