O Poder Judiciário brasileiro na era digital : projetos de Inteligência Artificial no Superior Tribunal de Justiça (STJ)

Abstract

A inteligência artificial, um campo da ciência da computação dedicado à criação de sistemas que executam tarefas tipicamente humanas, tem sido uma força transformadora em diversas áreas, incluindo o Direito. Desde sua origem na década de 1950, a inteligência artificial evoluiu significativamente, passando de conceitos teóricos para aplicações práticas que hoje impactam profundamente a sociedade. No Direito, a inteligência artificial está sendo utilizada para prever resultados de casos, gerenciar fluxos processuais e realizar buscas inteligentes de jurisprudência, entre outras funções. A incorporação da inteligência artificial no sistema judiciário brasileiro já está em andamento, com iniciativas significativas no Conselho Nacional de Justiça (CNJ) e no Superior Tribunal de Justiça (STJ). Projetos como o Sistema Athos e o Sistema Sócrates exemplificam o uso dessa tecnologia para aumentar a eficiência e a precisão dos processos judiciais. Esses sistemas não substituem a função dos servidores humanos, mas sim os auxiliam, especialmente em tarefas repetitivas e de grande volume, permitindo que os servidores se concentrem em atividades mais complexas e estratégicas. A implementação dessas tecnologias no STJ visa principalmente a otimização da triagem e análise de processos, acelerando a tomada de decisões e melhorando a qualidade das deliberações. Esse movimento é impulsionado pela necessidade de lidar com um volumoso acervo de processos e a sobrecarga do sistema judicial brasileiro, que frequentemente resulta em atrasos e ineficiências. Este trabalho se fundamenta em uma revisão bibliográfica e adota o método dedutivo para investigar as interações entre inteligência artificial e Direito, os impactos da inteligência artificial no sistema judicial e as iniciativas regulatórias em desenvolvimento.

Artificial intelligence, a field of computer science dedicated to creating systems that perform tasks typically associated with human intelligence, has been a transformative force in various areas, including Law. Since its inception in the 1950s, artificial intelligence has evolved significantly, transitioning from theoretical concepts to practical applications that profoundly impact society today. In the legal field, artificial intelligence is being used to predict case outcomes, manage workflow, and conduct intelligent jurisprudence searches, among other functions. The incorporation of artificial intelligence into the Brazilian judicial system is already underway, with significant initiatives at the Conselho Nacional de Justiça (CNJ) and the Superior Tribunal de Justiça (STJ). Projects like the Athos system and the Socrates system exemplify the use of this technology to increase the efficiency and accuracy of judicial processes. These systems do not replace the role of human servers but rather assist them, especially in repetitive and high-volume tasks, allowing the servers to focus on more complex and strategic activities. The implementation of these technologies in the STJ aims primarily at optimizing the sorting and analysis of cases, speeding up decision-making, and improving the quality of deliberations. This movement is driven by the need to handle a voluminous backlog of cases and the overload of the Brazilian judicial system, which often results in delays and inefficiencies. This work is based on a literature review and adopts the deductive method to investigate the interactions between artificial intelligence and Law, the impacts of artificial intelligence on the judicial system, and the regulatory initiatives under development.
