Investigando o direito dos softwares de emulação: um estudo do caso Nintendo of America Inc. v. Tropic Haze

Abstract

Neste trabalho foi investigado o direito na prática da emulação. Em específico, os principais litígios que envolvem emuladores foram analisados com o intuito de compreender o caso Nintendo of America v. Tropic Haze LCC. Para isso, foi estudado o funcionamento da justiça federal norte-americana, dispositivos da lei de copyright e Digital Millennium Copyright Act, bem como os possíveis precedentes para o caso. No caso em questão, as partes entraram em acordo, sem a geração de precedentes, estipulando o pagamento de multa, admissão de prática de circunvenção e a promulgação de um permanent injunction que impede os membros da Tropic Haze LCC de se envolverem em projetos futuros de emulação de obras relacionadas à Nintendo.

This work investigated the law in the emulation procedure. Specifically, the main disputes involving emulators were analyzed in order to understand the case Nintendo of America v. Tropic Haze LCC. In this way, the functioning of the US federal justice system, provisions of the copyright law and the Digital Millennium Copyright Act, as well as possible precedents for the case were studied. In the case in question, the parties reached an agreement, without generating precedents, stipulating the payment of a fine, admission of circumvention practices and the enactment of a permanent injunction that prevents the members of Tropic Haze LCC from engaging in future projects of emulation of works related to Nintendo.
