Responsabilidade Civil no âmbito do cyberbullying : desafios da era digital

Abstract

O presente trabalho tem por escopo analisar a relação entre o instituto da Responsabilidade Civil e o fenômeno do cyberbullying. Para isso, utiliza-se o método dedutivo, com base em revisão bibliográfica contemplando análise doutrinária e casos jurisprudenciais. De início, são apresentados os conceitos gerais de bullying e cyberbullying, com o intuito de contextualizar o trabalho. Em seguida, é tratado o cyberbullying como ato ilícito gerador de Responsabilidade Civil, relacionando o fenômeno com os pressupostos do instituto. Após, verifica-se a incidência da responsabilidade objetiva em certos casos de cyberbullying, isto é, quando outrem responde pelo dano causado pelo agente em virtude de ter cometido intimidação sistemática contra terceiro, independente de culpa da parte responsabilizada. Ao longo do trabalho, averigua-se também como o tema vem sendo tratado pela doutrina e pela jurisprudência dos Tribunais.

The present work aims to analyze the relation between the legal obligations of civil liability and the phenomenon of cyberbullying. For that end, the deductive method is used, based on bibliographic research contemplating doctrinal analysis and the jurisprudential cases. First, the concepts of bullying and cyberbullying are presented, in order to contextualize the work. Next, the phenomenon of cyberbullying is analyzed as an illicit act capable of generating civil liability, relating the phenomenon with the elements of liability. After, the incidence of strict liability on certain cases involving cyberbullying will be analyzed, that is, when another responds for the damage caused by the agent due to having perpetrated systematic intimidation against a third party. Over the course of the present work, the way the doctrine and the jurisprudence has been handling the subject will also be investigated.
