Chocolates com indicação geográfica : uma análise das especificações técnicas e desafios da implementação em Gramado

Abstract

Este estudo aborda a temática da Indicação Geográfica (IG) de Chocolate Artesanal Gramado na modalidade de Indicação de Procedência (IP), explorando a recente concessão do registro da IP em contraste com a tradicional fabricação de chocolates na região. O estudo tem por objetivo analisar o caderno de especificações técnicas (CET) da IP Gramado para avaliar se as regras específicas foram pontos críticos de implementação da IP e sobre como estas regras se conectam com o conceito de “procedência”. Os objetivos específicos incluíram avaliar a participação na construção das especificações técnicas, entender as dificuldades na implementação da IG, e analisar como as especificações podem afetar a entrada de novos participantes. A metodologia empregada é descritiva e exploratória, com coleta de dados por meio de análises bibliográficas, documentos públicos e questionários. O estudo revela que as regras específicas do CET foram pontos críticos na implementação da IP, especialmente no que tange à exigência de produção da massa de cacau em Gramado. Quanto à conexão com o conceito de "procedência", observou-se que a produção de chocolate em Gramado está mais associada a um movimento turístico do que a características específicas do local. A pesquisa também indica que a construção do CET foi liderada por um grupo pequeno de empresas, não representando a coletividade de forma abrangente. As conclusões apontam que o CET pode dificultar a entrada de novos participantes devido às exigências de maquinário específico e aquisição de matéria-prima. A pesquisa destaca a importância das Indicações Geográficas em proteger tradições e saber-fazer únicos, mas questiona a relevância de estabelecer especificações técnicas que beneficiam apenas um pequeno grupo. O trabalho enfatiza que as IGs devem proteger a coletividade e seu patrimônio cultural, em vez de privilegiar exclusivamente o mercado. A IG Gramado, embora reconhecida, desafia a harmonização entre o mercado e as características locais, trazendo à tona questões relevantes para a propriedade intelectual no contexto das indicações geográficas.

This study addresses the issue of the Gramado Artisanal Chocolate Geographical Indication (GI) in the form of an Indication of Origin (IP), exploring the recent grant of the IP registration in contrast to the traditional manufacture of chocolates in the region. The study aims to analyze the technical specifications (CET) of the Gramado IP to assess whether the specific rules were critical points in the implementation of the IP and how these rules connect with the concept of "provenance". The specific objectives included evaluating participation in the construction of the technical specifications, understanding the difficulties in implementing the GI, and analyzing how the specifications can affect the entry of new participants. The methodology employed is descriptive and exploratory, with data collected through bibliographic analysis, public documents and questionnaires. The study reveals that the specific rules of the CET were critical points in the implementation of the GI, especially regarding to the requirement to produce cocoa mass in Gramado. As for the connection with the concept of "origin", it was observed that chocolate production in Gramado is more associated with a touristic movement than with specific characteristics of the place. The research also indicates that the construction of the CET was led by a small group of companies, not representing the community as a whole. The conclusions point out that the CET can make it difficult for new participants to enter due to the requirements of specific machinery and the acquisition of raw materials. The research highlights the importance of Geographical Indications in protecting unique traditions and know-how, but questions the relevance of establishing technical specifications that benefit only a small group. The work emphasizes that GIs should protect the collectivity and its cultural heritage, rather than exclusively privileging the market. The Gramado GI, although recognized, challenges the harmonization between the market and local characteristics, bringing up issues relevant to intellectual property in the context of geographical indications.
