Os litígios estruturais têm origem na forma de funcionamento de uma estrutura – seja uma instituição pública ou privada, seja uma prática reiterada, seja uma política pública – cuja disfuncionalidade causa, fomenta ou permite a violação de um direito fundamental. Esses litígios possuem alto grau de complexidade e conflituosidade, subdividindo-se em diversos subgrupos de interesses distintos e imbricados, cujas peculiaridades interferem diretamente no processo. Dessa forma, os processos chamados estruturais, cujo objetivo é a reformulação dessa estrutura, vêm sendo cada vez mais sistematizados pela doutrina. O Código de Processo Civil mostra-se suficiente para a conformação desse rito processual, uma vez que possui uma feição flexível, com a previsão de diferentes técnicas especiais. Assim, analisar-se-á a Ação Civil Pública nº 5014215-16.2016.4.04.7200, para averiguar (i) se o caso se trata de um litígio coletivo estrutural; (ii) se o caso foi construído de acordo com flexibilização procedimental intrínseca a um litígio coletivo estrutural; e (iii) se as decisões foram hábeis a tutelar o direito material. Nesse sentido, será feito um cotejo entre a teoria do processo coletivo estrutural com o caso prático, a fim de verificar se a condução diferenciada do procedimento é a forma mais efetiva para a tutela do direito material. ...

Structural litigation originate from the way in which a structure operates – be it a public or private institution, be it a reiterated practice, be it a public policy – whose dysfunctionality causes, instigate or permits the violation of a fundamental right. These disputes have a high degree of complexity and conflict, subdividing into several subgroups of distinct and intertwined interests, whose peculiarities directly interfere in the process. Structural litigation originate from the way in which a structure operates – be it a public or private institution, be it a reiterated practice, be it a public policy – whose dysfunctionality causes, instigate or permits the violation of a fundamental right. These disputes have a high degree of complexity and conflict, subdividing into several subgroups of distinct and intertwined interests, whose peculiarities directly interfere in the process. Therefore, the so-called structural processes, whose objective is the reformulation of this structure, have been increasingly systematized by the doctrine. The Civil Procedure Code proves to be sufficient for the conformation of this procedural rite, since it has a flexible feature, with the prediction of different special techniques. Thus, Public Civil Action No. 5014215-16.2016.4.04.7200 will be analyzed to find out (i) whether the case is a structural collective litigation; (ii) if the case was constructed in accordance with procedural flexibility intrinsic to a structural collective litigation; and (iii) if the decisions were able to protect the substantive law. In this sense, a comparison will be made between the theory of the structural collective process and the practical case, in order to verify if the differentiated conduct of the procedure is the most effective way for the protection of material law. ...
