Modulação dos efeitos da decisão do tema 69 do STF : ações rescisórias x princípio da proteção da confiança

Abstract

Esta monografia tem como objetivo analisar as implicações da modulação de efeitos estabelecida pelo Supremo Tribunal Federal no julgamento dos embargos declaratórios da União no RE 574.706/PR (Tema 69), sobretudo no que diz respeito à maneira como vem sendo usada para restrição da liberdade dos contribuintes, frustrando sua confiança em atos estatais anteriores. Para tal, faz-se, inicialmente, uma análise teórica dos conceitos fundamentais à compreensão do caso. Nesse sentido, examina-se o instituto da modulação de efeitos, principalmente na declaração de inconstitucionalidade de normas jurídicas, e o princípio da proteção da confiança legítima, que tutela as situações jurídicas subjetivas do indivíduo que confia nos atos estatais e exerce os seus direitos em conformidade com eles. Estabelecidas essas premissas teóricas, parte-se para a investigação do caso concreto decorrente do Tema 69 do STF, visando a responder se são cabíveis as ações rescisórias ajuizadas pela União contra as decisões judiciais que transitaram em julgado no período entre o julgamento de mérito do RE 574.706/PR, em 15/03/2017, e a definição de modulação de efeitos dessa decisão de mérito, a qual ocorreu em 13/05/2021. Procura-se responder a esse problema a partir de uma perspectiva predominantemente material, com base nos direitos fundamentais e nos princípios que estão em jogo, em especial a liberdade individual em face do estado de desproteção que atualmente se vive perante os atos estatais retroativos. Defende-se, nessa perspectiva, a aplicação da irretroatividade dos atos estatais enquanto princípio que tutela a confiança do cidadão e garante a proteção do indivíduo contra ameaças aos seus direitos fundamentais.

This monograph aims to analyze the implications of the effects modulation established by the Brazilian Federal Supreme Court in the judgment of the declaratory appeals filed by the Union in the case RE 574.706/PR (Topic 69), especially regarding the way it has been used to restrict the taxpayer’s freedom, frustrating their confidence in previous state acts. To this end, a theoretical analysis of the fundamental concepts for understanding the case is initially carried out. In this sense, the institute of effects modulation is examined, mainly in the declaration of unconstitutionality of legal norms, as well as the principle of protection of legitimate expectations, which protects the subjective legal situations of individuals who trust in state acts and exercise their rights in accordance with them. Having established these theoretical premises, the investigation of the concrete case arising from Topic 69 of the Brazilian Federal Supreme Court is pursued, aiming to answer whether the rescissory actions filed by the Union against the judgments that had already become final during the period between the merit judgment of RE 574.706/PR on March 15, 2017, and the definition of the effects modulation of that merit decision, which occurred on May 13, 2021, are admissible. The problem is approached from a predominantly material perspective, based on fundamental rights and principles that are at stake, especially individual freedom in the face of the state of lack of protection currently experienced due to retroactive state acts. From this perspective, the application of the non-retroactivity of state acts is defended as a principle that protects the citizen's confidence and guarantees the protection of the individual against threats to their fundamental rights.
