As origens do direito internacional moderno : a contribuição de Francisco de Vitoria

Abstract

Este trabalho se perguntará a respeito da contribuição de Francisco de Vitoria para a doutrina do Direito Internacional moderno. Investiga-se, inicialmente, as origens do direito internacional, a partir da visita a definições de ius gentium presentes na obra de pensadores relevantes na tradição do conceito. A partir disso, passa-se a argumentar que a contribuição do mestre salmantino para a doutrina internacionalista reside na introdução de um novo vocabulário para tratar das relações internacionais. Parte-se para uma investigação acerca da doutrina do dominium na filosofia política de Vitoria, buscando-se compreender o verdadeiro significado da afirmação do autor no sentido de que os povos nativos da América eram verdadeiros senhores de seus bens no âmbito público e privado. Examina-se as elaborações de teor antropológico presentes em De indis, buscando-se compreender a análise de Vitoria a respeito da natureza dos povos nativos. A partir disso, passa-se a verificar os direitos que Vitoria identifica na ordem natural para regrar as interações entre povos e indivíduos estrangeiros. Por fim, investiga-se a doutrina da guerra justa na obra do mestre de Salamanca, buscando-se compreender em que sentido as comunidades políticas são compreendidas como entes independentes, ainda que sujeitas a sanções da comunidade internacional.

This research aims to study the contribution of Francisco de Vitoria to the doctrine of modern International Law. Initially, it investigates the origins of international law based on an analysis of the definitions of ius gentium as proposed by the relevant thinkers in the tradition of the concept. It is then argued that the contribution of Vitoria to the internationalist doctrine lies in the introduction of new concepts for dealing with international relations. The first concept examined is the doctrine of dominium. The political denotation of dominium is investigated in order to understand Vitoria’s statement in the sense that the native peoples of America had dominion of their properties both publicly and privately. The anthropological content presented in De indis is examined, seeking to understand Vitoria's analysis of the nature of the native peoples. Based on this, it is possible to verify the rights that Vitoria identifies in the natural order that govern the interactions among foreign peoples and individuals. Finally, the doctrine of the just war is investigated in the work of the master from Salamanca so as to understand in what sense political communities are understood as independent entities, even though they might be subject to sanctions from the international community.
