Estatuto da pessoa com deficiência e seus efeitos previdenciários

Abstract

O presente trabalho tem o objetivo de analisar a Lei n. º 13.146/2015, denominada de Estatuto da Pessoa com Deficiência, e seus efeitos na assistência social, no que tange o benefício de prestação continuada. Será feita uma análise do Estatuto da Pessoa com Deficiência, junto de suas alterações no regime das incapacidades civis. Após será introduzido o regime previdenciário brasileiro, com a análise da Assistência Social no que tange o Benefício de Prestação Continuada em casos de deficiência física. Ao final, serão comparadas as alterações do Estatuto da Pessoa com deficiência no Benefício de Prestação Continuada, analisando a hipótese de aumento deste benefício em casos de dependência de terceiros.

This paper has the objective of analyzing Law n. 13.146 / 2015, the so called the Statute of the Person with Disabilities, and its effects on social assistance, regarding the Benefit of Continued Provision. An analysis of the Statute of the Person with Disabilities will be made, along with its changes in the regime of civil incapacities. Afterwards, the Brazilian social security system will be introduced, with the analysis of Social Assistance regarding the Benefit of Continued Provision in cases of physical disability. Finally, the changes in the Statute of the Person with Disabilities will be compared to Benefit of Continued Provision, analyzing the hypothesis of increasing this benefit in cases of dependence of third parties.
