A aplicabilidade da verificação da procedência das informações na investigação criminal

Abstract

Este trabalho versa sobre pesquisa que trata da aplicabilidade da verificação da procedência das informações e sua utilização como instrumento de auxílio na fase de investigação preliminar, tendo como objeto de análise e reflexão o advento da Lei n. 13.869/2019, a Lei de Abuso de Autoridade. Neste sentido, o estudo tem como propósito abordar os principais aspectos da investigação criminal preliminar, estabelecendo relação com o Inquérito Policial, principal instrumento de investigação utilizado pela Polícia Judiciária. Também objetiva analisar o instituto da verificação da procedência das informações, bem como apontar as críticas doutrinárias e técnicas acerca desse instrumento de investigação. Além disso, visa a apresentar uma breve análise da Lei de Abuso de Autoridade - Lei n. 13.869/2019, definindo sua origem histórica e previsão no ordenamento jurídico brasileiro, bem como sua abrangência na investigação criminal.

This work deals with research that deals with the applicability of verifying the origin of information and its use as an aid instrument in the preliminary investigation phase, having as object of analysis and reflection the advent of Law No. 13,869/2019, the Law of Abuse of Authority. In this sense, the study aims to address the main aspects of the preliminary criminal investigation, establishing a relationship with the Police Investigation, the main investigative instrument used by the Judicial Police. It also aims to analyze the institute of verification of the origin of the information, as well as to point out the doctrinal and technical criticisms about this research instrument. In addition, it aims to present a brief analysis of the Law of Abuse of Authority - Law no. 13,869/2019, defining its historical origin and foresight in the Brazilian legal system, as well as its scope in the criminal investigation.
