A presente monografia objetiva analisar o art. 139, IV do Novo Código de Processo Civil, responsável por consagrar o princípio da atipicidade dos meios executivos, determinando que cabe ao juiz determinar todas as medidas indutivas, coercitivas, mandamentais ou sub-rogatórias necessárias para assegurar o cumprimento de ordem judicial, inclusive nas ações que tenham por objeto prestação pecuniária. Assim, o artigo permite ao juiz a possibilidade de aplicação de medidas executivas não expressamente previstas em lei. A novidade do dispositivo referido está na aplicação de medidas executivas em prestações de pagar quantia, hipótese que não era antes prevista pelo ordenamento jurídico brasileiro. A partir deste estudo, buscar-se-á entender quais são os parâmetros do magistrado na aplicação de tal dispositivo legal, de forma que a tutela jurisdicional seja efetivada para o exequente, sem que, contudo, haja arbitrariedades por parte do juiz que violem os direitos do executado. Trata-se de uma importante cláusula geral de efetivação que vem consolidando, cada vez mais, a prestação de uma tutela jurisdicional adequada, efetiva e tempestiva dos direitos. The present monography aims to analyze the article 139, IV from the New Code of Civil Procedure, responsible for consecrating the principle of atypicality of the executive means, establishing that is up to the judge to appoint all the inductive, coercive, writ and sub-rogatory means needed to secure the fulfilment of the judicial order, including the actions that aim pecuniary charge. This article allows the judge to apply the executive means not clearly defined by law. The novelty of this device is in the application of executive means in pecuniary charges, hypothesis that wasn’t envisioned before by the Brazilian legal system. From this study, it will be sought to understand the magistrate parameters in the application of this legal device, in a way that the judicial protection is effective to the creditor without, however, having arbitrariness from the judge that violates the rights of the judgment debtor. It is an important consummation general clause that is consolidating, more each time, the adequate, effective and timely judicial protection. For this study, mainly theory, it was used a qualitative method based in bibliographic and judicial research as information elements. ...
