O direito ao trabalho de imigrantes após a nova lei de migração brasileira

Abstract

Será conduzido, no presente Trabalho de Conclusão de Curso, um estudo acerca do direito ao trabalho a imigrantes no Brasil, a partir da nova Lei de Migração (Lei nº 13.445/2017), tendo como parâmetro as diretrizes da Organização Internacional do Trabalho. A legislação migratória brasileira apresentou uma mudança de paradigma importante com a implementação da Lei de Migração, quando comparada ao Estatuto do Estrangeiro: passamos do panorama de Segurança Nacional para o da Segurança Humana, elevando o migrante a um patamar de equidade de direitos que já era preconizado pela Constituição Federal. Os princípios e diretrizes internacionais sobre a migração laboral demonstravam a necessidade de renovação legislativa brasileira, por isso o objetivo do trabalho é a analisar quais foram efetivamente as mudanças trazidas pela Lei de Migração quanto ao direito ao trabalho de imigrantes no Brasil.

It will be conducted, in the present Bachelor’s Thesis, a study about the right to work of immigrants in Brazil, based on the new Migration Law (Law nº 13.445/2017), having as a parameter the orientation of the International Labour Organization on the subject. The Brazilian immigration legislation shows an important shift paradigm with the implementation of the Migration Law, when compared with the Foreigner’s Statute: changing to the National Security paradigm, to the Human Security paradigm, elevation the migrant to a standard of equity of rights that was already advocated by the Federal Constitution. International principles and guidelines on labour migration have demonstrated the need for Brazilian legislative reform, therefore the purpose of this Thesis is to analyse the actual changes brought by the Migration Law regarding the right to work to immigrants in Brazil.
