Verdade e Direito em Georges Kalinowski : a justificação do fundamento semântico do direito

Abstract

A presente dissertação pretende analisar a fundamentação dos juízos jurídicos na verdade prática segundo a obra de Georges Kalinowski, de modo a conceber um fundamento semântico ao direito, ou seja, se existe um fundamento substancial verdadeiro que confere objetividade e obrigatoriedade às normas morais e jurídicas. Desse modo, será tratado, em primeiro lugar a noção de verdade e conhecimento práticos, bem como de que ontologia uma posição cognitivista em matéria moral parte, analisando, antes disso, as especificidades da razão prática em contraposição à razão teórica. Com tal análise se pretende demonstrar a verdade e objetividade dos juízos estimativos (de valor), bem como, após, será investigada sua justificação racional. Conhecidos e verificados os juízos de valor, passar-se-á, então, ao modo como tais estimações fundamentam as normas. Sendo assim, estuda-se a verdade da lei natural e da lei humana e sua conseqüente justificação racional. Por fim, torna-se possível, então, analisar a semântica das normas morais e jurídicas.

This essay intends to analyze the foundations of the legal judgments in practical truth according to the work of Georges Kalinowski, in order to design a semantic foundation to the law, or if there is a truth substantial foundation that gives objectivity and obligatoriness to the moral and legal norms. Thus, it is treated, first the notion of practical truth and practical knowledge as well as which ontology the moral cognitivist position take off, by, before that, analyze the specifics of practical reason as opposed to theoretical reason. With this analysis is intended to demonstrate the truth and objectivity of judgments estimates (value) and, later, its rational justification will be investigated. Known and verified the value judgments, it will pass then to how those estimates bases norms. Thus, it will be studied the truth of natural law and human law and its consequent rational justification. Finally, it is then possible to analyze the semantics of moral norms and legal.
