O papel da responsabilidade civil na prevenção do bullying escolar

Abstract

O presente trabalho de conclusão de curso trata da incidência da Responsabilidade Civil nos episódios de bullying escolar, objetivando demonstrar que o referido instituto pode contribuir para a prevenção dessa violência por meio, não apenas de sua função ressarcitória, mas também de sua função punitivo-preventiva. A primeira parte analisa aspectos conceituais acerca do bullying; a gênese histórica do fenômeno; abordando, ainda, as diferentes práticas discriminatórias no ambiente escolar, indicando os sujeitos envolvidos em tais práticas, bem como as consequências pessoais para as vítimas e para a sociedade como um todo. A segunda parte é dedicada ao instituto da Responsabilidade Civil e suas funções, dando ênfase à função preventiva no que diz respeito ao bullying escolar. Por fim, na terceira parte, é analisada a Responsabilidade Civil, no que diz respeito ao bullying escolar das escolas públicas e privadas, fazendo uma breve análise jurisprudencial a respeito do tema.

This present work deals with the incidence of Civil Liability in the episodes of school bullying. It aims to demonstrate that the mentioned Institute may contribute to the prevention of this violence not only by its compensatory function, but also by its punitive-preventive function. The first part analyzes conceptual aspects of bullying, the historical genesis of the bullying phenomenon, it approches the different discriminatory practices in the school environment, and it also shows the people involved in such practices, as well as the personal consequences for the victims and society itself. The second part is dedicated to the institute of Civil Liability and its functions, it emphasizes the preventive function regarding to school bullying. Finally, in the third part, the Civil Liability is analyzed as far as school bullying in public and private schools is concerned and it also makes a short jurisprudential analysis on the subject.
