Análises jurídica e econômica do casamento e de seus aspectos patrimoniais

Abstract

A presente dissertação visa a promover uma análise jurídica e econômica do contrato matrimonial e de seus aspectos patrimoniais. Tem como objetivo, mais do que isto, esclarecer quais os benefícios da Análise Econômica do Direito na explicação da formação, vigência e dissolução do contrato de casamento. Para tanto, primeiramente abordar-se-á o vínculo conjugal sob uma perspectiva exclusivamente jurídica, enfatizando, ainda, os principais contratos passíveis de serem celebrados entre os consortes e a forma como o Judiciário brasileiro atribuilhes soluções no advento da dissolução conjugal. Em um segundo momento, a finalidade será averiguar como a Análise Econômica do Direito atua no presente contexto, com ênfase nas teorias da Sinalização e da Assimetria Informativa, buscando-se, desta forma, uma correlação interdisciplinar que gere unidade ao trabalho. Por fim, serão mencionados os principais benefícios atribuídos à aplicação do ferramental da análise econômica na seara jusfamilista.

This dissertation aims to promote an economic and legal analysis of the marriage contract and its property aspects. Aims, more than that, to clarify the benefits of Economic Analysis of Law in the explanation of the formation, duration and dissolution of the marriage contract. Therefore, firstly, the focus will be on the marital bond under a purely legal perspective, emphasizing, also, in the main contracts that can be concluded between the consorts and how the Brazilian Judiciary gives them the solutions in the advent of marital dissolution. In a second step, the purpose is to verify how the Economic Analysis of Law operates in the present context, with emphasis on the Signaling and Asymmetric Information theories, trying to make an interdisciplinary correlation which gives the work an unified view. Finally, there will be mentioned the main benefits attributed to the application of the tools of economic analysis in this Family Law context.
