Tráfico de drogas e territórios criminalizados em Porto Alegre : uma análise da geografia jurídica das abordagens por atitude suspeita

Abstract

Este trabalho busca investigar a existência de um componente geográfico nas abordagens policiais por “atitude suspeita”, ou seja, se o espaço da cidade em que se encontra o indivíduo abordado tem alguma influência para essas práticas jurídicas. Assim, questiona-se se não ocorre, paralela e complementarmente à criminalização de indivíduos com determinadas características já descrita pela literatura no campo da criminologia, a criminalização de determinados espaços da cidade, tendo como base para essa reflexão as categorias teóricas espaços territoriais e representações do espaço. A metodologia usada para averiguar tal hipótese foi a análise dos acórdãos de apelações crime em processos de tráfico de drogas do Tribunal de Justiça do Rio Grande do Sul julgados no último triênio (2015-2017), referentes à comarca de Porto Alegre, que continham as expressões "atitude suspeita" e "via pública" em seu inteiro teor. A leitura dos 773 acórdãos encontrados teve seu foco nas denúncias do Ministério Público, transcritas no início do voto, tendo como fonte subsidiária de informação os depoimentos prestados pelos policiais, também usualmente transcritos na fundamentação da decisão judicial. Buscou-se identificar em cada acórdão a presença de representações do espaço nas narrativas policiais; o oferecimento ou a ausência uma descrição da atitude que motivou a abordagem; e, por fim, nos casos em que presente, se tal descrição referia-se a um comportamento efetivamente suspeito ou a um uso do espaço público que em outras circunstâncias seria considerado normal A análise quantitativa dessas variáveis independentes, compiladas em um único banco de dados, sugeriu haver influência do espaço da cidade na construção da suspeita policial. Em uma fase posterior da pesquisa foi elaborado, com base nos endereços coletados dos acórdãos, um mapeamento das ocorrências por “atitude suspeita” em via pública no que tange ao tráfico de drogas, constatando-se uma concentração das abordagens por “atitude suspeita” em áreas de ocupação irregular para fins de habitação popular. Propõe-se, com base nos dados e no referencial teórico analisados, algumas considerações a cerca das representações do espaço que permeiam as práticas jurídicas das forças policiais, em especial no que tange à compreensão de vilas, favelas e assemelhados como espaços territoriais associados ao crime e, mais especificamente, o narcotráfico.

This study seeks to analyze the existence of a geographical component in police approaches by "suspicious attitude", or, in other words, to investigate if the city spaces in which the individual is approached is a factor of influence for this legal practice. Thus, it is questioned if the criminalization of certain urban spaces does not occur, in a parallel and complementary fashion to the criminalization of individuals with certain characteristics, already described by the literature in the field of criminology. The proposed reflection is based on the theoretical categories territorial spaces and representations of the space. The methodology used to investigate this hypothesis was the analysis of the judgments of criminal appeals in drug trafficking cases of the Court of Justice of Rio Grande do Sul judged in the last triennium (2015-2017), referring to the region of Porto Alegre, which contained the expressions "suspicious attitude" and "public road" in their entirety. The scrutiny of the 773 judgments found had its focus on the complaints of the Public Prosecutor, transcribed at the beginning of the legal judgment, and, as a subsidiary source of information, on the testimonies provided by the police, usually transcribed as means of providing basis for the judicial decision. The examination aimed to identify, in each judgment, the presence of representations of space in the police narratives; the offering or the absence of a description of the attitude that motivated the approach; and, finally, in cases where it was present, whether such a description referred to an effectively suspicious behavior or to a use of public space which otherwise would be considered normal The quantitative analysis of these independent variables, compiled in a single database, suggested that city space influence the construction of police suspicion. In a later phase of the research, a mapping of the occurrences by "suspicious attitude" on the public road with regard to drug trafficking was elaborated, based on the addresses collected from the judgments. The geographical representation showed a concentration of the approaches by "suspicious attitude" in city areas marked by irregular occupation for the purpose of popular housing. Based on the data and theoretical framework analyzed, considerations on the representations of space that permeate the legal practices of the police forces are elaborated, especially regarding the understanding of “vilas”, “favelas” and the like as territorial spaces associated with crime and, more specifically, drug trafficking.
