A parceria entre a administração pública e as entidades privadas sem fins lucrativos a partir do marco regulatório das organizações da sociedade civil (MROSC) na oferta da educação infantil em Porto Alegre

Abstract

A Dissertação “Parceria entre a Administração Pública e as entidades privadas sem fins lucrativos a partir do Marco Regulatório das Organizações da Sociedade Civil (MROSC) na oferta da Educação Infantil em Porto Alegre” analisa a elaboração da política de parceria entre o poder público e a sociedade civil, pelo governo municipal de Porto Alegre, na perspectiva do que dispõe a Lei Federal 13.019/2014 e o Decreto Municipal nº 19.775/2017. A dissertação apresenta como o novo ordenamento jurídico modifica a relação da parceria entre o poder público e as entidades privadas sem fins lucrativos na perspectiva da oferta da educação infantil no município de Porto Alegre. A pesquisa investiga o conteúdo da proposta, os sujeitos e a correlação de forças presentes no marco legal em âmbito nacional e local. Para tanto, embasa-se teórica e metodológicamente no materialismo histórico e em autores que fundamentam os estudos do Grupo de Pesquisa Relações entre o Público e o Privado na Educação (GPRPPE). O conceito de Estado e a reflexão sobre a redefinição do papel do Estado buscamos em Vera Peroni (2016) e em David Harvey (2005). Consubstanciamos em Evaldo Vieira (2007) o fundamento para os direitos e a política social. A partir de Ball e Olmedo (2013), assim como em Peroni, apoiamos a reflexão sobre as mudanças nas fronteiras entre o público e o privado. Buscamos ainda, os conceitos de neoliberalismo e terceira Via, enquanto estratégias do capital conforme definidos por Peroni (2016) e, a partir de Guidens (2007) a estrutura da política em terceira via. Abordamos o conceito de Terceiro Setor a partir de Montaño (2002). A metodologia consistiu na compreensão do cenário jurídico e político da política pesquisada, no estudo das respectivas legislações, assim como procedemos a análise documental e do processo em âmbito nacional e local. Os resultados da pesquisa mostram que há o agravamento da precarização da qualidade social da educação infantil ofertada pela parceria no município de Porto Alegre; o aumento da desigualdade do atendimento; acentua a desresponsabilização do Estado para o trato da questão social e para o atendimento ao direito à educação para a criança pequena, repassando a responsabilidade da organização da sociedade civil para o atendimento à Meta 1 do Plano Nacional de Educação (2014-2024) e do Plano Municipal de Educação (2015-2025); não há observância para as Resoluções vigentes do Conselho Municipal de Educação de Porto Alegre; intensificam-se as obrigações das entidades parceiras; acentua-se a transigência para a contratação docente; pende para a manutenção do caráter assistencial ao invés de para a reafirmação da identidade educacional para a oferta.

The thesis “Partnership between Public Administration and the non-profit private sector from the Regulatory Framework of the Civil Society Organizations (known in Brazil by the Portuguese acronym, MROSC) in the supply of children’s education in Porto Alegre”, analyzes the partnership policy elaboration between the public sector and the civil society, by the local government, in accordance to the Federal Law 13.019/2014 and Municipal Decree 19.775/2017. The dissertation presents how the new legal order modifies the relationship between the public power and the non-profit private segment from the perspective of the offer of Early Childhood Education in the city of Porto Alegre. The research also examines the proposal contents, the players and the correlation of forces existing in the legal framework at national and local level. For this purpose, it is based theoretically and methodologically on historical materialism and authors who base the studies of the Research Group on Relations between Public and Private in Education (known in Brazil by the Portuguese acronym, GPRPPE). The concept of the State and the reflection on the redefinition of the role of the State are sought in Vera Peroni (2016) and David Harvey (2005). In Evaldo Vieira (2007) we found the foundation for rights and social policy. From Ball and Olmedo (2013), as well as in Peroni, we support the reflection on the changes in the borders between the public and the private. We also seek the concepts of neoliberalism and Third Way, as strategies of capital as defined by Peroni (2016) and, from Guidens (2007), the structure of politics in third way. We approach the concept of Third Sector from Montaño (2002). The methodology consisted in the understanding of the legal and political scenario of the policy studied, in the study of the respective legislation, as well as the documentary and process analysis at a national and local level. The results of the research show that there is a worsening of the precariousness of the social quality of child education offered by the partnership in the city of Porto Alegre; increased inequality of care; emphasizes the State's lack of responsibility for dealing with the social issue and for attending the right to education for the young child, passing on the responsibility of the civil society organization to comply with Goal 1 of the National Education Plan (2014-2024) and the Municipal Education Plan (2015-2025); there is no observance of the current Resolutions of the Municipal Council of Education of Porto Alegre; the obligations of partner entities are intensified; accentuated the commitment to the hiring of teachers; depends on the maintenance of the assistance character rather than on the reaffirmation of the educational identity for the offer.
