Sobre o instituto do habeas corpus: análise do instrumento e do seu cabimento coletivo à luz do voto do relator min. Ricardo Lewandowski no HC 143.641/STF

Abstract

O presente trabalho intenta estudar o instituto do habeas corpus e o seu cabimento coletivo no direito pátrio. Para isso, primeiramente se busca a conceituação do instituto, a apresentação de sua natureza jurídica e o desenlace histórico desse com o passar dos anos, além de apresentar e diferenciar as espécies de habeas corpus existentes. Ato contínuo, se adentra no tema principal deste trabalho: a possibilidade de manejo dessa ação de forma coletiva. Essa pesquisa procurará responder ao problema com base em análise feita do voto do relator, ministro Ricardo Lewandowski, no bojo do habeas corpus 143.641, recentemente julgado, o qual foi o primeiro habeas corpus coletivo da história recente do Supremo Tribunal Federal a ser conhecido e provido. Por fim, pretende-se concluir pela possibilidade do manejo dessa ação em sua forma coletiva, haja vista ser mecanismo que garante o acesso à justiça e possibilita que o direito seja realmente mecanismo eficaz de promoção da justiça.

This undergraduate thesis intends to study the institute of the habeas corpus and your collective handling in Brazil. For that, first we demand the conceptualization of the institute, the presentation of your legal nature and your historical outcome, beyond present and differentiate the species of habeas corpus. Immediately thereafter, we enter in the principal theme of this thesis: the possibility of your collective handling. This following study intends to answer this problem based on an analysis of the vote of the min. Ricardo Lewandowski, in the bulge of the HC 143.641, recently judged, which was the first collective habeas corpus on the recent history of the Brazilian Supreme Court to be known and provided. Lastly, we intend to conclude by the possibility of the handling of this action in your collective way, because is a mechanism that ensures the access to justice and enables that the law can really be an effective justice mechanism.
