Este trabalho analisa o empréstimo consignado no Brasil à luz da nova teoria contratual e das normas e princípios orientadores do Direito do Consumidor. Este trabalho analisa o empréstimo consignado no Brasil à luz da nova teoria contratual e das normas e princípios orientadores do Direito do Consumidor. Expõe a mudança de paradigma no direito contratual brasileiro, com a preponderância da boa-fé e a busca pela equidade nas relações contratuais, especialmente quando há vulnerabilidade de uma das partes em relação à outra, como é o caso das relações de consumo. Trata dos deveres das instituições financeiras na concessão de crédito, com enfoque na modalidade contratual que autoriza o desconto das parcelas diretamente nos rendimentos do consumidor. Destaca o risco de superendividamento, analisando as técnicas interpretativas utilizadas pela jurisprudência e as propostas de solução indicadas pela doutrina, atentando para a necessidade de se observar o princípio da dignidade humana na readequação do contrato, preservando-se o que se define por mínimo existencial. ...

This paper analyzes the direct consigned loan in Brazil in the light of the new contractual theory and the norms and guiding principles of Consumer Law. It exposes the paradigm shift in Brazilian contractual law, with the preponderance of good faith and the search for equity in contractual relations, especially when there is vulnerability of one party to the other, as is the case of consumer relations. It deals with the duties of financial institutions in the granting of credit, focusing on the contractual modality that authorizes the discount of the installments directly in the consumer's income. It highlights the risk of over-indebtedness, analyzing the interpretive techniques used by jurisprudence and the proposed solutions indicated by the doctrine, paying attention to the need to observe the principle of human dignity in the readjustment of the contract, preserving what is defined by existential minimum. ...
