Violência doméstica e familiar praticada contra as mulheres negras

Abstract

Este trabalho de conclusão de curso tem como tema a violência doméstica e familiar contra as mulheres negras. No primeiro capítulo será analisada a construção e a desconstrução do patriarcado, sob essa perspectiva será considerada, também, a dupla forma de discriminação ao qual se submete a mulher negra: de gênero e de raça. Diante dessa realidade, busca-se, nesse trabalho, fazer uma interconectividade de gênero/raça e como essas práticas violentas se diferenciam na população feminina negra. Também será trabalhada nesse capítulo a forma como a mulher negra é vista pela sociedade e de que maneira essas avaliações refletem na identidade e na subjetividade da mulher negra. No segundo capítulo sopesa-se os objetivos e o marco histórico da Lei nº 11.340/06 – Lei Maria da Penha -; sua importância como principal instrumento nacional de combate à violência contra a mulher, avaliando-se, também, as controvérsias causadas por ela e de que forma ela é trabalhada pelo judiciário e pelo governo. Salienta-se, nesse capítulo, a importância da lei também ser vista como forma de combate a violência racial dentro do âmbito doméstico. Finaliza-se o trabalho discorrendo sobre a importância que tem a organização do movimento de mulheres para que atemática específica dessas mulheres saia da obscuridade e passe a ser pensada com uma efetiva forma de política feminista racial.

This dissertation is about the subject of domestic and family violence against black women. The first chapter features an analysis of the construction and deconstruction of the existing patriarchy. Furthermore, from this perspective, it considers the double form of discrimination to which black woman are subjected: gender-based and race-based. In light of this reality, this paper seeks to interconnect gender/race with how these violent practices differ amongst the black female population. In addition, this chapter addresses the manner in which black women are viewed by society and how these evaluations are reflected in the identity and subjectivity of black women. The second chapter weighs the objectives and milestone of Law no. 11.340/06 - The Maria daPenha Act -; its importance as the main instrument in Brazil for combating violence against women, also evaluating the controversies it has caused and how it is applied by the judiciary and government. This chapter also highlights the importance of the law being seen as a way of combating racial violence inside the home. This dissertation ends by discussing the importance of the women's movementorganising itself in order for the specific cause of these women to come out from obscurity and to become thought of as an effective form of racial feminist policy.
