Atos notariais e atos registrais : essencialidade do sistema notarial e registral brasileiro

Abstract

O presente trabalho objetiva traçar um paralelo entre a atividade notarial e registral brasileira e o desenvolvimento do homem durante sua vida, crescimento e interação social, para que se possa mensurar o grau de essencialidade dos tabelionatos de notas e dos registros público no que se refere às atuais e complexas relações interpessoais e patrimoniais. Proposto o tema, buscou-se, na descrição de cada ato estudado (nascimento, casamento, divórcio, morte, etc), aprofundar a importância dos elementos responsáveis pela segurança jurídica e coesão social na atividade de registros e notas. Por fim, como consequência lógica deste estudo, chegar-se-á à patente importância da publicidade deste instituto, como ferramenta de perfectibilização da função social.

The following paper aims to draw a parallel between the Brazilian notarial activity and the registry activity, and the growth of man during his life, growing and social interaction, so we can measure the degree of essentiality of the notary’s offices and public records in relation to the current and complex interpersonal and patrimonial relationships. Once the theme was proposed, a research was made on the description of each studied act (birth, matrimony, divorce, death, etc.) to examine carefully the importance of the responsible elements for the juridical safety and social cohesion in the activity of registration and records. Finally, as a logical consequence of this study, we will get to the importance of the publicity in this institute, as an instrument of social function progress.
