Reforma do estado no Brasil (1995-1998) : o plano diretor da reforma do aparelho do estado brasileiro

Abstract

Esta dissertação tem como tema a reforma do Estado, objetivando, a partir do exame e da sistematização de um programa concreto de mudanças, o Plano Diretor da Reforma do Aparelho do Estado, formulado no âmbito do Ministério da Administração e Reforma do Estado, no primeiro governo de Fernando Henrique Cardoso, analisar as implicações da reforma para o desenho e as funções desempenhadas pelo Estado brasileiro. Descrevem-se, ainda, os principais acontecimentos relacionados à formulação do Plano Diretor da Reforma do Aparelho do Estado e o processo de alteração da legislação constitucional e infraconstitucional de suporte às mudanças nele previstas. Procura-se demonstrar que, ao contrário do que propugna o senso-comum, não há com as reformas projetadas uma redução da importância do Estado, mas o aprofundamento da aparente separação entre a “esfera econômica” e a “esfera política”, onde o descarte de determinadas atividades tem como contrapartida o fortalecimento de outras. Demonstra-se, igualmente, que o processo de implementação da reforma é pautado por conflitos que evidenciam a recusa e/ou a desconfiança em relação à nova lógica proposta, razão pela qual as mudanças somente avançam com maior vigor nos momentos de crise. Por fim, o resultado desses conflitos e as limitações impostas pelo ajuste fiscal conduzirão à fragmentação e a baixa implementação das mudanças previstas no Plano Diretor da Reforma do Aparelho do Estado.

The theme of this dissertation is the State Reform and it aims, based on the examination of the case-study of a concrete programme of changes, namely the Main Plan of Reforms of the Administration of the State, which were formulated by the Ministry of Administration and State Reform, during Fernando Henrique Cardoso’s first government, to analyze the implications of the reform on the structure and the functions executed by the State. The main events related to the Main Plan of Reforms of the Administration of the State are also being described as well as the process of change of the constitutional legislation, which support the institutions herein foreseen. Unlike what could be supposed by common sense, it will be demonstrated that the projected reforms did not lead to a reduction of the State’s importance, but a deepening of the apparent separation between the ‘economic scope’ and the ‘political scope’, where discarding certain activities had as compensation, the strengthening of others. It has also been demonstrated that the process of implementation of the Reform has been marked by conflicts which show clearly the refusal and/or mistrust regarding the new proposed logic, which is the reason why the changes progress only more vigorously during moments of crisis. Finally, the result of these conflicts and the restrictions imposed by the fiscal adjustment will bring about the fragmentation and the low implementation of the changes foreseen by the Main Plan of Reforms of the Administration of the State.
