As fronteiras da informalidade : a relação da prefeitura e da câmara de vereadores de Porto Alegre com os vendedores ambulantes

Abstract

A presente dissertação examina a relação entre a Prefeitura de Porto Alegre e os vendedores ambulantes do município no ano de 2003. O objetivo principal é estabelecer a forma com a qual ocorre a relação do Estado com um grupo social heterogêneo, em parte organizado em entidades, que opera no desenvolvimento de atividades na via pública, as quais podem ser compreendidas em três situações: legais e regulares; ilegais e irregulares; legais e irregulares. A legalização trata da comercialização de produtos lícitos, calcada nas legislações federal e municipal, e a regulamentação incorpora os locais e horários estabelecidos pela Prefeitura e pela legislação municipal para o exercício da atividade como vendedor ambulante. No âmbito teórico, o estudo fundamenta-se no processo de construção de espaços públicos de discussão e organização da sociedade civil para fazer com que os seus interesses e reivindicações sejam representados nas instituições políticas e no Estado. A questão do comércio informal, no escopo deste trabalho, está centrada em três segmentos: a Secretaria de Produção, Indústria e Comércio, a Câmara de Vereadores, do Sindicato do Comércio de Vendedores Ambulantes e Comércio Varejista de Feirantes no Estado do Rio Grande do Sul e do Sindicato dos Camelôs de Porto Alegre. Com base nesta análise, pretende-se identificar as características das políticas desenvolvidas pela Prefeitura, a participação da Câmara de Vereadores na questão do comércio informal e as formas com as quais os vendedores ambulantes organizam-se e encaminham os seus interesses. Com isso, busca-se estabelecer alguns dos principais pontos de impasse e limites na relação do Estado com um segmento da sociedade civil multifacetado e com interesses variados.

The following thesis focuses in the relationship between town hall of Porto Alegre and ambulant salesmen in 2003 year. The aim main is establish how happen the relation of the State with a social group heterogeneous, in part organized, working in the public place. The ambulant salesmen may be understood in three situations: legal and regular; unlawful and irregular and legal and irregular. The legalization include of the commercialization of licit products, established on the federal and municipal legislations, and the regulation established to town hall and the municipal legislation to operation of the informal commerce. From a theoretical perspective, the study have how the center focal point in the process of construction of publics spaces to discussion and organization of civil society to represent your interests and demands in the politics institutions on State. The question of informal commerce, in this study, has with the center focal point three segments: the offices' Production, Industry and Commerce; town council and ambulant salesmen entities'. Based on this analysis, this paper intends to identify the characteristics of the politics developed to Porto Alegre's town hall and the participation of town council on the question of the informal commerce and how ambulant salesmen organize yourself and orient yours interests, to establish some of the points principals of impasse and limits in the relationship of the State and one diverse segment of civil society.
