Direito dos animais : uma proteção efetiva

Abstract

Neste trabalho serão abordadas questões relativas à proteção dispensada aos animais em face de atos cruéis, bem como soluções à crise relativa à ineficácia de tal tutela. Serão analisados temas sob às diferentes óticas, que explicam o bem jurídico protegido pela norma ambiental e a possibilidade de estender a consideração de sujeitos de direitos aos seres da natureza. Ao discutir tais assuntos, defender-se-á uma forma de pensar diferente da visão tradicional antropocêntrica, traço marcante da cultura ocidental. Procurar-se-á, dessa forma, responder a questionamentos que, eventualmente, possam surgir, contribuindo para a formação de um entendimento abrangente e consistente no que diz respeito a assuntos pertinentes a nossa matéria.

In this paper will be addressed issues relating to the protection afforded to animals in face of cruel acts, as well as solutions to the crisis on the ineffectiveness of such guardianship. It will analyzed issues related to the different perspectives that explain the legal interest protected by Environmental Law and the possibility of extending the consideration of subject of rights to beings of nature. When discussing such matters, it will be defended a different way of thinking from traditional anthropocentric vision, striking feature of Western culture. It will seek, thus, answering questions that eventually arise, contributing to the formation of a comprehensive and consistent understanding with regard to relevant matters to our subject.
