Abstract in Portuguese (Brasil)
Este trabalho tem por objetivo promover um estudo acerca da extensão do dever de motivação das decisões judiciais, a partir da perspectiva da implicação do princípio do devido processo legal em razão da qual as partes tem o direito a exercer influência efetiva sobre a formação do convencimento do juiz. Pretende, ainda, estudar, a partir da definição da extensão deste dever, os limites que são impostos à correção de seu eventual descumprimento por meio da oposição de embargos de declaração.
Abstract
This work aims to study the extent of the duty of motivation of court decisions from the perspective of the implication of due process of law by which the litigants have the right to exert influence on the formation of conviction of the judge. It also aims to study, from the definition of the extent of this duty, limits that are imposed to correction of its eventual noncompliance through the submission of a motion for clarification.
