Este trabalho monográfico foi desenvolvido com o intento de investigar a congruência atual da escala global de penas encerrada no bojo da normativa penal brasileira e oferecer uma resposta à problemática relativa à proporcionalidade entre as sanções cominadas aos mais diversos tipos penais e a ordem axiológica constitucional. Para tanto, foram analisadas, na primeira parte deste estudo, primeiramente, as conexões entre a Teoria do Estado e o Direito penal, dando-se primazia às transformações no modo de conceber o Estado e os efeitos que, a partir daí, se fizeram sentir no tocante à incidência do poder punitivo estatal. Em segundo momento, deu-se ênfase aos diálogos travados entre Constituição e Direito penal, enfocando-se, principalmente, as limitações formais e materiais que a ordem axiológica constitucional impõe a este. Assentadas as bases mínimas para uma devida compreensão acerca da teoria dos bens jurídicos, optou-se por traçar o seu desenvolvimento histórico e seus fundamentos, para, adiante, estruturar sua dinâmica, bipartida em dois grandes grupos de bens jurídicos – individuais e transindividuais -, e, assim, trasladar referida doutrina para o cenário constitucional brasileiro atual. Já na segunda parte do trabalho, dissertou-se, inicialmente, acerca dos critérios político-criminais legislativo-dogmáticos de seleção penal dos bens jurídicos e, após, a respeito do complexo problema de saber se existe uma escala de importância de valores penalmente tuteláveis a orientar o legislador penal em sua atividade, salientando-se, ainda, a crise que toma conta do conceito de bem jurídico na atualidade. Prosseguiu-se a análise com o recurso ao postulado normativo aplicativo da proporcionalidade em matéria de fixação de pena, a fim de delinear os contornos de uma correta expressão do bem jurídico-penal. No derradeiro capítulo deste estudo, manejou-se todo o instrumental até então colhido para averiguar a coerência endonormativa do direito penal brasileiro, tomando como pano de fundo a ordem axiológica constitucional brasileira e como base a teoria proporcionalista de Andrew Von Hirsch. Por fim, concluiu-se pela incoerência do sistema penal brasileiro, bem como pela inexistência, a priori, de superioridade entre bens jurídicos individuais e transindividuais a orientar a atividade do legislador, que deverá arrimar-se na dignidade da pessoa humana para cumprir seu múnus. ...

This monograph was developed with the intent to investigate the congruence of current global scale of sanctions enclosed in brazilian criminal law and to offer an answer to the problem of the proportionality between the penalties assigned to crimes and axiological constitutional order. Therefore, in the first fraction of this study, the connections between the state theory and the criminal law were studied, giving primacy to the transformations suffered by the way of conceiving the state and the effects thereafter felt in regarding the incidence of the state’s punitive power. In the second place, emphasis was placed on the dialogues that took place between Constitution and criminal law, mainly on the procedural and substantial boundaries imposed to this. Once settled the foundations for proper understanding the theory of legal interests, it was chosen to trace it’s historical development and its grounds, for, further, structure it’s dynamic, split into two groups of interests – individual and communitarian – and thus translate this doctrine to current brazilian scenario. In the second part of this treatise, the politician-criminal legal-dogmatic criterias of selection of legal interests were discussed, and, thus, about the complex issue of whether there is a scale of importance of values criminally protectable capable of being a guide to the legislature in criminal subjects, stressing also the crisis that takes the concept of legal interests today. The analysis continued by handling the proportionality postulate in fixing penalties in order to delineate the correct expression of legal interests criminally protectable. In the final fraction of this treatise, the instrumental above was handled to determine the congruence of brazilian criminal law, taking as background the axiological constitutional order and as base the theory of Andrew Von Hirsch. It was possible to conclude by the inconsistency of brazilian criminal law internal coherence, as well as the absence of a superiority between the individual legal interests and the communitarian ones.
