Medidas judiciais e extrajudiciais de enfrentamento ao bullying escolar e responsabilização civil das escolas

Abstract

Esta monografia teve por objetivo principal a busca pela solução de problemática relacionada ao bullying escolar, uma vez que por ser fenômeno recente, ainda não tem grande discussão nos meios jurídicos. A problemática desse tema relaciona-se com a dúvida de como e a partir de que meios podem a sociedade e o Estado lutarem contra essa ameaça. Ainda: quem deverá ser responsabilizado quando o bullying vem causar dano a alguém. Partindo da definição de bullying trazida pelos estudiosos da educação, procuramos traçar suas origens, suas causas e as consequências que ocasiona, para podermos entender melhor o que é, e como ocorre este fenômeno. Seguiu-se analisando, então quais os direitos dos principais afetados pelo bullying – as crianças- seriam infringidos e quem tem o dever de zelar pela não violação desses direitos. Por fim, analisamos sobre quem deveria recair a responsabilidade civil quando há dano causado pelo bullying.

This monograph was aimed at the search for the solution of problems related to school bullying, once for being a recent phenomenon, has no great impact on legal means. The theme of this issue relates to the question of how and from what ways can society and the state combat threat. Also: who should be held liable when bullying is causing harm to anyone. Starting from the definition of bullying brought by education scholars, we trace its origins, its causes and consequences it causes, so that we can better understand how it is, and how this phenomenon occurs. This was followed by analyzing, then what rights the most affected by bullying - the child would be infringed and who has the duty of ensuring the non-infringement of these rights. Finally, we analyzed over who should fall liability when there is damage caused by bullying.
