A saída temporária e o permesso premio : uma análise comparada entre os institutos reintegrativos no âmbito da execução penal brasileira e italiana

Abstract

A presente pesquisa versa sobre o atual contexto do instituto da saída temporária no Brasil, especialmente após as severas alterações ocasionadas pela Lei n° 14.843/24, em contraponto com o permesso premio italiano, instituo análogo à saída temporária brasileira e criado pela Lei nº 663/86, que alterou a Lei do Ordenamento Penitenciário italiano, adicionando, dentro outros, o art. 30-ter. O objetivo geral da pesquisa é analisar os institutos, com suas respectivas particularidades, bem como o cenário da execução penal brasileira e suas inspirações no modelo italiano. Deste modo, adotando técnica de pesquisa bibliografia e documental comparada e utilizando-se o método de abordagem hipotético-dedutivo, dividiu-se a pesquisa em três partes: a primeira, examina a saída temporária, desde sua criação com a Lei de Execução Penal de 1984, até o advento da Lei n° 14.843/24, observando seus requisitos legislativos, finalidades e percepção pública; a segunda, examina o permesso premio italiano, com breve análise da evolução legislativa italiana no tema da execução penal, assim como as principais características do instituto; em terceiro, uma análise comparada entre os institutos e seus contextos. Como resultado principal verificou-se uma maior repressão do legislativo brasileiro no tocante à saída temporária, ao contrário do que ocorre com o permesso premio, apesar da rigidez do ordenamento italiano em diversos âmbitos, o qual é utilizado como inspiração pelo legislador brasileiro.

This research deals with the current context of the temporary release institute in Brazil, especially after the severe changes brought about by Law n° 14.843/24, in contrast to the Italian permesso premio, an institute analogous to the Brazilian temporary release and created by Law n° 663/86, which amended the Italian Penitentiary Ordinance Law, adding, among others, art. 30-ter. The general objective of the research is to analyze the institutes, with their respective particularities, as well as the scenario of Brazilian penal execution and its inspirations in the Italian model. Thus, adopting a comparative bibliographical and documentary research technique and a hypothetical-deductive approach, the research was divided into three parts: the first examines temporary release, from its creation with the Penal Execution Law of 1984, until the advent of Law n° 14.843/24. Secondly, the Italian permesso premio, with a brief analysis of Italian legislative developments in the field of penal execution, as well as the main characteristics of the institute; and thirdly, a comparative analysis between the institutes and their contexts. The main conclusion was the existence of a greater repression on the part of the Brazilian legislature with regard to temporary release, unlike what happens with the permesso premio, despite the rigidity of the Italian system in various areas, which is used as inspiration by the Brazilian legislature.
