A consagração do princípio da autodeterminação da vontade coletiva no tema 1046 do STF : análise jurisprudencial sobre turnos ininterruptos de revezamento

Abstract

O presente trabalho apresenta uma análise jurisprudencial e legislativa acerca das mudanças promovidas pela Lei no 13.467/2017 no âmbito do Direito Coletivo do trabalho. A partir da reforma, analisa-se a definição do Tema de repercussão geral 1046 do STF, que gerou mudanças jurisprudenciais no Direito Coletivo Trabalhista. O trabalho busca compreender como o Tribunal Superior do Trabalho fixou a jurisprudência concernente aos turnos ininterruptos de revezamento com as mudanças promovidas pela reforma trabalhista, especialmente sobre a previsão legal acerca da prevalência do negociado sobre o legislado, bem como a fixação do Tema 1046. Para isso, o trabalho abordará toda a construção do Tema 1046 e os respectivos votos dos ministros do STF que levaram ao julgamento e à formulação do referido Tema. A metodologia adotada se dará por meio do método de pesquisa indutivo, utilizando técnicas de pesquisa de consulta à doutrina justrabalhista, bem como à legislação e jurisprudência do TST. A pesquisa identificou dificuldade em estabilizar completamente a jurisprudência para estabelecer o patamar mínimo civilizatório e estipular o rol de matérias não passíveis de negociação coletiva. Também foi possível analisar o fortalecimento da negociação coletiva através dos princípios constitucionais e a prevalência do negociado sobre o legislado, que sustentaram a base para a estipulação do Tema 1046 do STF. Por fim, analisou-se a aplicação e o respeito ao Tema de repercussão geral 1046 do STF pela maioria das turmas do Tribunal Superior do Trabalho, validando as negociações coletivas concernente aos turnos ininterruptos de revezamento.

This work presents a jurisprudential and legislative analysis of the changes brought by Law No. 13.467/2017 in the field of Collective Labor Law. Following the labor reform, the paper examines the definition of the STF’s General Repercussion Theme 1046, which resulted in jurisprudential changes in Collective Labor Law. The study seeks to understand how the Superior Labor Court (TST) established jurisprudence regarding uninterrupted shift work in light of the changes introduced by the labor reform, particularly concerning the legal provision on the prevalence of negotiated agreements over legislated rules, as well as the establishment of Theme 1046. To achieve this, the paper will address the entire development process of Theme 1046 and the corresponding votes of STF ministers that led to the ruling and formulation of the Theme. The methodology adopted will follow the inductive research method, using research techniques involving the consultation of labor law doctrine, as well as legislation and TST jurisprudence. The research identified challenges in fully stabilizing jurisprudence to establish a minimum civilizational standard and define the list of matters not subject to collective bargaining. Additionally, the study analyzed the strengthening of collective bargaining through constitutional principles and the prevalence of negotiated agreements over legislated rules, which formed the foundation for the formulation of STF Theme 1046. Finally, the paper examined the application and observance of STF’s General Repercussion Theme 1046 by most panels of the Superior Labor Court, validating collective agreements regarding uninterrupted shift work.
