Direito territorial indígena : o caso da Aldeia Ymã Fág Nhin em Porto Alegre

Abstract

O presente trabalho investiga a atuação municipal na efetivação do direito ao território indígena em Porto Alegre, com foco na criação e regulamentação da aldeia Ymã Fag Nhin, na Lomba do Pinheiro. Utilizando o Estudo de Caso como metodologia, a pesquisa analisa os fatores sociais, jurídicos e políticos que permitiram a consolidação de territórios indígenas na área urbana, mesmo fora do procedimento demarcatório constitucional. A dissertação aborda a invisibilidade dos indígenas em contextos urbanos, a luta por territórios, e as políticas públicas alternativas adotadas pela administração municipal. A partir da análise do processo administrativo e da mobilização política Kaingang, o estudo conclui que a regulamentação territorial através de iniciativas municipais preenche lacunas jurídicas e sociais, oferecendo uma alternativa para a garantia de direitos fundamentais em contextos de urbanização.

This study investigates the role of municipal governance in ensuring indigenous territorial rights in Porto Alegre, focusing on the creation and regulation of the Ymã Fag Nhin village in Lomba do Pinheiro. Using a case study methodology, the research explores the social, legal, and political factors that enabled the establishment of indigenous territories within an urban environment, despite not following the constitutional demarcation procedure. The dissertation addresses the invisibility of indigenous peoples in urban contexts, their struggle for territory, and the alternative public policies implemented by the municipal administration. By analyzing the administrative process and the Kaingang political mobilization, the study concludes that municipal initiatives for territorial regulation fill legal and social gaps, providing an alternative pathway for securing fundamental rights in urban settings.
