Letras e mãos sobre muros; ou, a paisagem pichada/pixada : uma análise do discurso de criminalização da pichação/pixação

Abstract

Esta dissertação analisou o discurso que criminaliza a pichação/pixação no estado do Rio Grande do Sul, ou seja, como ele funciona, quais as suas bases e que efeitos de poder ele produz sobre a paisagem. Em suma, este estudo foi guiado pelo seguinte problema: como funciona o discurso que criminaliza a pichação/pixação e quais as suas implicações na paisagem urbana? O objetivo desta pesquisa, portanto, foi compreender a formação e o funcionamento desse discurso, tendo em vista que esses dois elementos estão ligados aos conflitos que se dão sobre a cidade e que determinam os modos de vê-la, pensá-la e vivê-la. Para trabalhar essas ideias, foi estabelecida como base teórica o pensamento de Foucault (2005, 2014d, 2015a, 2015b, 2023), especialmente no que tange ao seu método – arqueológico e genealógico – de análise de discurso e as suas ideias sobre as relações de poder. A partir dessa base, outras referências foram articuladas com o arquivo empírico proposto, isto é, os acórdãos de processos de crime de pichação julgados no RS entre maio de 2011 e dezembro de 2023, e foi no movimento dessa articulação entre a teoria e o arquivo que esta pesquisa foi desenvolvida. Foi esse movimento também que levou à criação de uma estrutura dupla para esta dissertação, composta por dois capítulos sequenciais (o primeiro e o último), e três capítulos autônomos que desdobraram temas específicos da análise, o que possibilitou a construção de uma narrativa que buscou pensar os objetos da pesquisa em texto, ou seja, nas potencialidades e limitações singulares da escrita. Ao fim, as linhas dessa narrativa delinearam não somente os contornos do discurso que criminaliza o picho/pixo, mas também aquilo que foi chamado de dispositivo-paisagem, que não é apenas um paciente dos efeitos produzidos pelo discurso jurídico, e sim um conjunto heterogêneo que possibilita a própria constituição de tal discurso, bem como a formação de outros meios de pensar e agir sobre a cidade, seja para defender uma imagem considerada ideal, ou mesmo para resistir a ela. Portanto, é nas tramas desse dispositivo que as estratégias de criminalização de práticas sociais, de constituição de sujeitos criminosos e de intervenção sobre o espaço urbano se constituíram e continuam a funcionar; porém, é também nessas tramas que as tensões das forças de resistência se movem, sendo a pichação/pixação uma delas.

This dissertation analyzed the discourse that criminalizes pichação/pixação (graffiti) in the state of Rio Grande do Sul, that is, how it works, what its bases are, and what effects of power it produces on the landscape. In short, this study was guided by the following problem: how does the discourse that criminalizes pichação/pixação work and what are its implications for the urban landscape? The objective of this research, therefore, was to understand the formation and functioning of this discourse, bearing in mind that these two elements are linked to the conflicts that take place over the city and which determine the ways of seeing it, thinking about it and living it. To work on these ideas, Foucault's thinking (2005, 2014d, 2015a, 2015b, 2023) was established as a theoretical basis, especially concerning his method – archaeological and genealogical – of discourse analysis and his ideas on power relations. From this base, other references were articulated with the selected empirical archive, that is, the judgments of pichação/pixação cases tried in Rio Grande do Sul between May 2011 and December 2023, and it was in the movement of this articulation between theory and archive that this research was developed. It was also this movement that led to the creation of a double structure for this dissertation, made up of two sequential chapters (the first and last), and three autonomous chapters that unfolded specific themes of the analysis, which made it possible to construct a narrative that sought to think about the objects of the research in text, that is, in the singular potentialities and limitations of writing. In the end, the lines of this narrative outlined not only the contours of the discourse that criminalizes pichação/pixação, but also what was called the landscape-dispositif, which is not just a patient of the effects produced by the legal discourse, but a heterogeneous set that enables the very constitution of this discourse, as well as other means of thinking and acting on the city, whether to defend the image considered ideal, or even to resist it. Therefore, it is in the networks of this dispositif that the strategies of criminalizing social practices, constituting criminal subjects and intervening in urban space have been formed and continue to function; however, it is also in these networks that the tensions of the forces of resistance move, pichação/pixação being one of them.
