Owen Fiss encontra Alexandre de Moraes : análise das decisões do TSE restritivas à liberdade de expressão no contexto eleitoral de 2022

Abstract

Durante o período eleitoral de 2022 houve um aumento significativo de conflitos envolvendo liberdade de expressão e de imprensa, acesso à informação, desinformação e disseminação de fake news, instando as instituições a deliberar muito rapidamente sobre seus contornos e limites constitucionais. Assim, o Tribunal Superior Eleitoral, ao lado do Supremo Tribunal Federal, ganhou ainda mais relevância enquanto instituição responsável por realizar e fiscalizar as eleições em âmbito nacional, além de julgar casos de conflitos de direito eleitoral. Nesse sentido, este trabalho busca analisar as decisões do TSE relativas a restrições à liberdade de expressão durante o período de campanha eleitoral de 2022, à luz das contribuições da teoria de Owen Fiss e do entendimento da Comissão Interamericana de Direitos Humanos a respeito do tema.

During the 2022 election period there was a significant increase in conflicts involving freedom of expression and the press, access to information, disinformation and the spread of fake news, urging institutions to deliberate very quickly on their constitutional contours and limits. Thus, the Superior Electoral Court, along with that of the Federal Supreme Court, gained even more relevance as an institution responsible for conducting and supervising elections at the national level, in addition to judging cases of conflicts of electoral law. In this sense, this paper seeks to analyze the decisions of the TSE regarding restrictions on freedom of expression during the 2022 election campaign period, in the light of the contributions of the theory of Owen Fiss and the understanding of the Inter-American Commission on Human Rights on the subject.
