Democracia, teoria do estado e teoria do direito

Abstract

Democracia sempre foi um projeto em andamento. Praticamente todas as nações do globo consideram-se democráticas, mas a democracia é difícil de compreender, e ainda mais difícil de realizar. Neste trabalho, o objetivo é estabelecer as bases para a democracia e suas reivindicações frente à teoria do Estado (especialmente a teoria da separação dos poderes) e frente à teoria do direito. O estudo considerará o arranjo institucional dos poderes no Brasil (Executivo, Legislativo e Judiciário) e a teoria do direito predominante (neoconstitucionalismo) para questionar se esse modo de organizar o Estado e de compreender o direito são compatíveis com as reivindicações da democracia.

Democracy has always been a work in progress. Mostly every nation worldwide deems itself as a democratic country, but democracy is hard to understand, and even harder to achieve. In this work, the goal is to establish the grounds for democracy and set its claims towards theories of political power (especificaly considering the way to set appart the branches of government) and also towards theories of law. The study will consider the arrangement on the branches of government that took place in Brazil (Executive, Parliament and Judiciary) and the predominant theory of law (which is called neoconstitucionalism) to argue if these ways to arrange the Estate and to understand Law are compatible with the claims of democracy.
