O financiamento público da saúde no Brasil

Abstract

O presente trabalho possui como escopo o estudo sobre o trato do direito à saúde na Constituição da República de 1988. Ressalta-o como direito fundamental, sobre o qual recai tutela estatal própria, mediante a imposição de obrigações a todas as esferas de governo. Identifica as variadas fontes de custeio especificadas no texto constitucional, bem como as balizas mínimas de aplicação de recursos públicos em saúde impostas à União, aos Estados, ao Distrito Federal e aos Municípios. Analisa o impacto da judicialização da saúde no orçamento público. Conclui que o financiamento público ressai como importante mecanismo de concretização do direito à saúde no País.

The present work aims to study the deal of health rights in the Constitution of the Federative Republic of Brazil. It emphasizes as a fundamental right, on which the State has its own responsibility, by imposing obligations on all spheres of gov ernment. It identifies the various sources of funding specified in the constitutional text, as well as the minimum percentagesfor the application of public health re sources imposed on the Union, the States, the Federal District and the Munici palities. It analyzes the impact of the judicialization of Health in the public budget. It concludes that public financing is an important mechanism to secure of the right to health in Brazil.
