A efetivação do direito fundamental social à saúde

Abstract

O núcleo do presente trabalho gira em torno do direito fundamental social à saúde, cujo substrato constitucional resta amparado pelos artigos 6º e 196 da Constituição Federal. Analisa, primeiramente, o direito à saúde na condição de direito fundamental social, passando pelo cotejo de alguns dos aspectos mais relevantes para a efetivação desse direito. Dentre esses objetos, destaca a importância da implementação/efetivação de políticas públicas, bem como as diferentes correntes acerca da possibilidade de intervenção do Poder Judiciário nesse campo. Aborda, por fim, o posicionamento que vem sendo adotado pelo Supremo Tribunal Federal no julgamento de demandas que pleiteiam o fornecimento de medicamentos.

The core of this work revolves around the fundamental social right to health, which remains supported by the substrate constitutional Articles 6 and 196 of the Constitution. Examines, first, the right to health seen as fundamental social right, through the collation of some of the most important aspects for the realization of this right. Among these objects, highlights the importance of implementation / execution of public policies, and the different currents about the possibility of intervention by the judiciary in this field. Finally, discusses the stance that has been adopted by the Supreme Court in the trial of claims that wish to provide medicines.
