A aplicabilidade da norma da dignidade humana

Abstract

A norma da dignidade humana levanta muitas dúvidas sobre sua aplicabilidade, sobretudo por se tratar de uma norma com um alto grau de vagueza. Inexiste, na doutrina e na jurisprudência, um consenso acerca da estrutura e do conteúdo da norma da dignidade humana. O objetivo do presente trabalho, nesse sentido, é contribuir para uma melhor compreensão acerca dos conceitos e das teorias que envolvem a aplicabilidade da norma. Além disso, busca-se oferecer uma breve explanação sobre o surgimento e a evolução histórica do conceito de dignidade humana, o que proporciona a pré-compreensão das diferentes perspectivas que se adotam relativamente à dignidade humana. Em primeiro lugar, a dignidade humana é exposta como um conceito histórico; em segundo, como um conceito axiológico; e, por fim, como um conceito deontológico. Após, será examinada a estrutura da norma da dignidade humana, com base na teoria de Robert Alexy. Com base nesse exame, será posteriormente estudada a estrutura da restrição do direito fundamental da dignidade humana. Por fim, far-se-á a análise de duas importantes decisões, na Alemanha e no Brasil, que envolvem a aplicação da norma da dignidade humana. O estudo da estrutura da norma da dignidade humana contribui para a conclusão de que, no Brasil, não se pode afirmar que a dignidade humana represente um direito subjetivo, eis que inexistem meios para fazer valer tal direito.

The norm of the human dignity raises many questions regarding its applicability, mainly because it is a norm with a high degree of vagueness. Both literature and trial courts have not reached a consensus respecting the structure and the content of the norm of the human dignity. The objective of this paper is to contribute to a better comprehension of the concepts and theories that are involved in the applicability of the norm. Furthermore, the emergence and development of the concept of the human dignity will be briefly explained in order to provide a precomprehension regarding the different perspectives of the human dignity. First, the human dignity is presented as a historical concept; second, as an axiological concept; and third, as a deontological concept. Afterwards, the structure of the norm of the human dignity is examined from the perspective of Robert Alexy‟s theory. Based on that analysis, the structure of the restrictions of the fundamental right of the human dignity is also examined. Finally, two important decisions regarding the application of the human dignity norm that took place in Germany and Brazil are analyzed. The examination of the structure of the norm contributes to the conclusion that, in Brazil, due to the lack of procedural means, it is not correct to assert that the human dignity represents a subjective right.
