dc.description.abstractA preservação da propriedade é alicerce da soberania de um Estado. O direito a essa propriedade deve ser defendido por todas as Instituições que pertencem a esse Estado. Fazendo uma remição histórica verificaremos que a propriedade sempre foi uma preocupação por parte dos governantes. Inicialmente, o domínio e a posse de grande extensão de terras eram vistos como sinônimo de poder, sendo as grandes descobertas do século XVI a conseqüência maior desse período. Com o surgimento dos Estados Nacionais no final do século XVIII e início do século XIX, a necessidade de manter a integridade da base territorial conquistada levou os países a se envolverem em disputas diplomáticas e bélicas. Atualmente, a importância dos Direitos Fundamentais influenciou os Estados a insculpi-los em suas Constituições. É uma forma diferente de manter a soberania sobre o território pátrio. O Brasil como Estado Democrático de Direito também assim procedeu. O preâmbulo da Constituição da República Federal do Brasil em vigor desde 1988 declara ser o Estado brasileiro “destinado a assegurar os direitos sociais e individuais, a liberdade, a segurança, o bem-estar, o desenvolvimento, a igualdade e a justiça como valores supremos de uma sociedade fraterna, pluralista e sem preconceitos fundados na harmonia social e comprometidos, na ordem interna e internacional, com a solução pacífica das controvérsias.”. Embora não faça alusão ao direito à propriedade, o legislador ao mencionar ser o Estado responsável pela justiça quis afirmar que o Estado deve proteger a propriedade como forma de busca à igualdade e à justiça social. Essa idéia aparece claramente no caput do art. 5º: “garantindo-se a inviolabilidade do direito à propriedade”, e no inciso XXII: “é garantido o direito a propriedade”. Recentemente o surgimento dos movimentos sociais reivindicando acesso à terra, questionando índices de produtividade da propriedade privada, utilizando questões ideológicas, ambientais e étnicas como argumentos, põem em perigo o conceito de soberania do Estado brasileiro e a preservação da propriedade. Mencionam-se como as mais importantes questões dos movimentos sociais: a demarcação de terras indígenas e o pensamento ideológico do movimento dos trabalhadores rurais sem terra (MST).pt_BR
dc.description.abstractThe preservation of property is foundation of the State sovereignity. The right to the property must be defended for all institutions which belongs to this State. Doing a historic remission we verify that the property was always a worry for the governors. At the beginning the domain and possession of lands were seen as synonyms of power, been the greats discoveries of the XVI century the higher consequence of this period. With the emergence of the National States at the end of XVIII century e beginning of XIX century, the need to keep the integrity of the territory conquered take the countries to involve in diplomatic and warfare disputes. Nowadays the importance of the Fundamental Rights influenced the State to write them in their Constitutions. It’s a different way to keep the sovereignity over the Homeland. Brazil as a democratic state followed this way. The preamble of the Federal Constitution of Brazil since 1988 declares to be the brazilian state “ destined to ensure the social and individual rights, freedom, welfare and security, the development, the equality and justice as supreme values of a fraternal society, pluralist and without prejudice, founded in social harmony and compromised in the internal and international order with the pacific solution of the controversies.” Although don’t make allusion to the right of property, the lawmaker when mention be the state responsible for the justice, wanted to say that the State must protect the property as a way to search the equality and social justice. This idea appears clearly in the item 5 “ ensuring the inviolability to property right ” end the item XXII “end ensuring the right to property”. Recently the arisen of the social movements claiming access to land , questioning productivity indexes in the private property, using ideological issues, environmental and ethnics as arguments, endanger the concept of brazilian state sovereignity and the preservation of the property. Are mentioned as the most iimportant issues of the social movements: the demarcation of indigenous lands and the ideological thinking of the rural movement of workers without land (MST).en
