Políticas judiciárias baseadas em evidências? : os usos de pesquisas sociojurídicas empíricas pelo Conselho Nacional de Justiça

Abstract

Este trabalho estuda o uso de pesquisas sociojurídicas empíricas publicadas pelo Conselho Nacional de Justiça (CNJ) na formulação de políticas judiciárias. O CNJ possui funções de fiscalização, planejamento e controle dos serviços judiciais (REIS JUNIOR, 2017, p. 6), sendo propulsor de políticas que impactam não apenas o Judiciário, mas a sociedade. Tem, ao mesmo tempo, familiaridade com o universo das pesquisas empíricas, produzindo-as de forma interna, por parcerias institucionais e colaborações externas. Sendo assim, a pesquisa busca compreender se os estudos sociojurídicos empíricos publicados pelo CNJ têm repercutido na elaboração de Resoluções do CNJ, que estabelecem políticas judiciárias. Para responder esta pergunta, realiza-se uma análise documental buscando a coincidência entre temas das resoluções do CNJ com as temáticas de pesquisas anteriores publicadas pelo órgão, desde que sociojurídicas empíricas. Conclui-se que há pouca coincidência temática entre as pesquisas sociojurídicas empíricas publicadas pelo CNJ e as resoluções que estabelecem políticas judiciárias do CNJ. Do universo de 227 resoluções publicadas desde o mandato de Cezar Peluso, apenas 15.5% delas têm temas já estudados por pesquisas anteriores do CNJ, ou seja, a maior parte decide sobre temas ainda não estudados pelo órgão.

This dissertation studies the use of empirical socio-legal research created by the Brazilian National Council of Justice (NCJ) in the formulation of judicial policies. The National Council of Justice has functions of supervision, planning and control of judicial services (REIS JUNIOR, 2017, p. 6), creating policies that impact not only the Judiciary, but society. At the same time, it is familiar with the universe of empirical research, producing them internally, through institutional partnerships and external collaborations. Therefore, the research seeks to understand whether the empirical socio-legal studies published by the Brazilian National Council of Justice have had an impact on the elaboration of its resolutions, which establish judicial policies. To answer this question, a documental analysis is carried out seeking the coincidence between themes of the resolutions with the themes of previous researches published by the same institution, as long as they are empirical socio-legal. It is concluded that there is little thematic coincidence between the empirical socio-legal research published by the CNJ and the resolutions that establish judicial policies of the National Council of Justice. Of the universe of 227 resolutions published since Cezar Peluso's term in office, only 15.5% of them have topics already studied by previous research by the organization, that is, most decide on topics not yet studied by NCJ.
