Filiação socioafetiva e seus efeitos

Abstract

O presente trabalho trata de um tema que, apesar de ser uma realidade há alguns anos, somente de uns tempos para cá que vem sendo discutido e aceito pela sociedade que é o da filiação socioafetiva. Então, será apresentado como se dá a caracterização da filiação socioafetiva e quais são os seus efeitos. É utilizado o método da pesquisa bibliográfica. Para enriquecer o trabalho, foram analisadas decisões, principalmente, do Tribunal de Justiça do Rio Grande do Sul, mas também de outros estados, onde o site JusBrasil foi utilizado como dado de pesquisa. Por se tratar de um tema novo, a pesquisa jurisprudencial é importante para ver como o tema está sendo tratado nos tribunais. Conclui-se que é um assunto relevante e extremamente necessário para entender que existe além da família biológica, deve se levar em conta o vínculo afetivo entre as partes envolvidas.

The present work deals with a theme that, despite being a reality for some years, has only been discussed and accepted by society for some time now, which is that of socio-affective affiliation. Then, it will be presented how the characterization of socio affective affiliation takes place and what are its effects. The method of bibliographic research is used. To enrich the work, decisions were analyzed, mainly from the Court of Justice of Rio Grande do Sul, but also from other states, where the JusBrasil website was used as research data. As it is a new topic, jurisprudential research is important to see how the topic is being treated in the courts. It is concluded that it is a relevant and extremely necessary subject to understand that beyond the biological family, the affective bond between the parties involved must be taken into account.
