Sistema de direito, política e poder judiciário : uma análise realista das decisões judiciais

Abstract

O objetivo do presente trabalho é analisar a atuação do poder judiciário enquanto poder componente do estado democrático de direito. Para tanto se analisará a evolução do sistema de direito brasileiro a partir do comparativo dos dois sistemas de direito contemporâneos mais influentes: o direito romano-germânico e a common law. A partir desse traçado adentraremos na estrutura do estado democrático de direito e nas estruturas de poder, detalhando as funções e os fenômenos que circundam o poder judiciário, em especial. Por fim, analisaremos, a partir do binômio direito-política, os limites necessários às decisões judiciais, concebida da pré compreensão de que decisão judicial é um ato de vontade, afastando a premissa de neutralidade da mesma. Analisar-se-á, portanto, a estrutura do direito, do estado, do poder judiciário e da decisão judicial na sua faceta realista, buscando uma compreensão mais abrangente sobre as consequências da judicialização da política para fins de evitarmos um ativismo judicial que resulte em arbitrariedades, excesso de poder e decisionismos.

The objective of this study is to analyze the performance of the judiciary as a power component of the democratic state based on the rule of law. For that we examine the evolution of the Brazilian legal system from the comparison of the two most influential contemporary legal systems: The Roman-Germanic law and common law From that drawing we analyze the democratic state structure of law and structures power, detailing the functions and phenomena that surround the judiciary in particular. Finally, we will analyze, from the right-binomial policy, the limits required for judicial decisions, designed the pre-understanding that court decision is an act of will, away from the premise of neutrality of the same. Analyze It will, therefore, the structure of the law, the state, the judiciary and the judicial decision in its realistic aspect, seeking a more comprehensive understanding of the legalization of consequences of policy for the purpose of avoiding judicial activism resulting in arbitrariness, abuse of power and decisions.
