Entre a punição e a proteção : as perspectivas das mulheres em situação de violência doméstica e familiar que procuram o sistema de justiça criminal em Canoas/RS

Abstract

O presente trabalho analisa a atuação do sistema de justiça criminal em casos de violência doméstica e familiar, a partir das perspectivas das mulheres vítimas. A problemática foi desenvolvida a partir de noções e conceitos das criminologias crítica e feminista, tendo-se por base as ideias de que a violência de gênero contra as mulheres é um fenômeno complexo, que demanda uma ação efetiva do Estado, e de que o sistema penal é maculado de uma série de falhas que o tornam pouco efetivo na tarefa de resolver conflitos sociais importantes. Ainda, com o respaldo de referenciais teóricos da epistemologia feminista, entende-se que considerar as experiências das mulheres como recurso de análise é o meio mais eficaz de uma pesquisa chegar a um resultado que melhore a situação delas próprias, razão pela qual as mulheres em situação de violência são as protagonistas deste estudo. Assim, a pergunta que se buscou responder foi a seguinte: em que medida as mulheres em situação de violência doméstica e familiar que procuram o sistema de justiça criminal sentem-se atendidas em suas demandas? Metodologicamente, em contribuição à análise teórica, realizou-se pesquisa de campo, com a execução de entrevistas semiestruturadas com quatro mulheres que figuravam como vítimas em processo penais em curso no Juizado da Violência Doméstica da comarca de Canoas/RS. Os dados coletados foram divididos em três tópicos: as demandas apresentadas pelas mulheres; a atuação do sistema penal em seus casos; e o papel dessas mulheres como vítimas de violência no sistema de justiça criminal. Constatou-se que as mulheres, em sua maioria, costumam esperar proteção e soluções práticas para os seus relacionamentos quando recorrem às agências penais diante de uma violência sofrida, sendo exceção a demanda por punição do agressor. Além disso, foi possível observar que, como o sistema penal opera com a finalidade primordial de impor uma pena a quem pratica uma conduta delitiva, devido à satisfação das demandas que anteriormente apresentavam, as mulheres muitas vezes deixam de ver utilidade no prosseguimento do processo penal, inclusive manifestando descontentamento em relação a isso. Evidenciou-se, também, que as mulheres desconhecem os desdobramentos da sua decisão de buscar o sistema penal, que se veem de maneira alheia ao que está sendo decidido e que, por vezes, podem até se sentirem culpadas pelos prejuízos causados pela atuação do sistema ao agressor.

This paper analyzes the performance of the criminal justice system in cases of domestic and family violence from the perspective of the women victims. The problem was developed from notions and concepts of critical and feminist criminology, based on the ideas that gender violence against women is a complex phenomenon that demands an effective action from the State, and that the criminal justice system is tainted by a series of flaws that make it ineffective in the task of solving important social conflicts. Furthermore, with the support of theoretical references from feminist epistemology, it is understood that considering women's experiences as a resource for analysis is the most effective way for research to reach a result that improves their own situation, which is why women in situations of violence are the protagonists of this study. Thus, the question that was sought to be answered was the following: to what extent do women in situations of domestic and family violence who seek the criminal justice system feel that their demands are met? Methodologically, in contribution to the theoretical analysis, field research was carried out, with the execution of semi-structured interviews with four women who figure as victims in criminal processes in progress in the Court of Domestic Violence in the district of Canoas/RS. The data collected was divided into three topics: the demands presented by the women; the performance of the criminal system in their cases; and the role of these women as victims of violence in the criminal justice system. It was found that women, in their majority, usually expect protection and practical solutions for their relationships when they turn to the criminal justice agencies when faced with a suffered violence, being the exception the demand for punishment of the aggressor. Moreover, it was possible to observe that, since the penal system operates with the primary purpose of imposing a penalty on those who commit a criminal conduct, due to the satisfaction of the demands they previously presented, women often no longer see the usefulness of pursuing the criminal process, even expressing discontent in relation to this. It was also evident that women are unaware of the consequences of their decision to seek the criminal justice system, that they are unaware of what is being decided, and that sometimes they may even feel guilty for the harm caused to the aggressor by the actions of the system.
