dc.description.abstractAnalisa a tutela jurisdicional do direito à saúde a partir de uma leitura constitucional do processo civil. Busca entender a relação jurídica entre o indivíduo e o Estado a partir da eficácia da norma – a saúde é direito de todos e dever do Estado. Verifica como este direito pode se realizar por meio da adequação do processo, especialmente pela escolha da técnica processual. Utiliza abordagem metodológica indutiva apoiada em pesquisa bibliográfica e documental. Organiza a pesquisa em duas partes: tutela normativa do direito à saúde e tutela jurisdicional do direito à saúde. Na primeira parte, trata da proteção normativa do direito à saúde resgatando sua origem histórica como parte de um movimento internacional de criação e positivação dos direitos humanos, até chegar à sua estruturação enquanto norma. Recupera o movimento de reconhecimento do direito fundamental à saúde na Constituição de 1988. Reúne os principais dispositivos normativos que densificam a proteção do direito à saúde. Identifica a natureza de princípio no comando constitucional que posiciona o direito à saúde entre os direitos fundamentais sociais e verifica os efeitos desta classificação. A partir da aplicação do modelo lógico racional proposto por Alexy, realiza uma análise estrutural do artigo 196 da Constituição, identificando a relação jurídica entre o indivíduo, o Estado e o objeto da norma. Demonstra a dimensão subjetiva do direito à saúde. Localiza elementos que caracterizam o direito à saúde não apenas como um direito social, mas como um direito subjetivo, juridicamente apto a ser tutelado pela via jurisdicional. Avalia a posição do Estado na relação jurídica, identificando seu dever de realizar, por meio de prestações positivas, o direito à saúde. Aborda a eficácia normativa dos princípios avaliando a possibilidade de sopesamento entre o direito à saúde e outros princípios, concluindo que o direito à saúde admite ponderação apenas em relação a direitos de mesmo grau de importância, como o direito à vida. Na segunda parte, trata da proteção jurisdicional do direito à saúde por meio do processo civil estudando a justiça do processo sob a ótica constitucional e a atuação da tutela jurisdicional na realização do direito material. Estuda a concepção de processo justo, entendido como o processo que se volta à realização do direito material por meio de uma tutela jurisdicional efetiva, adequada e tempestiva. Analisa o princípio da adequação do processo dimensionando a importância da tutela adequada para a realização do direito à saúde. Identifica a compatibilidade das tutelas satisfativas com a realização efetiva do direito à saúde. Aborda a técnica processual da antecipação da tutela e sua pertinência à tutela jurisdicional do direito à saúde. Conclui que a dimensão subjetiva do direito à saúde determina sua tutela jurisdicional independente de sopesamento de princípios; entre as técnicas processuais disponíveis, a antecipação da tutela se sobressai pela sua adequação, ao potencializar a efetividade e a tempestividade da tutela jurisdicional do direito à saúde.pt_BR
dc.description.abstractThis monograph analyzes the jurisdictional protection of the right to health from a constitutional reading of the civil process. It seeks to understand the legal relationship between the individual and the State, based on the effectiveness of the norm – health is everyone's right and the State's duty. It verifies how this right can be realized through the adequacy of the process, especially through the choice of adequate procedural technique. It uses an inductive methodological approach, supported by bibliographic and documental research. The monograph has two parts: normative protection of the right to health and jurisdictional protection of the right to health. In the first part, it investigates the normative protection of the right to health rescuing its historical origin as part of an international movement of creation and affirmation of human rights, until reaching its structuring as a norm. It recovers the movement of recognition of the fundamental right to health in the 1988 Brazilian Constitution. It brings together the main normative provisions that strengthen the protection of the right to health. It identifies the nature of principle in the constitutional command that places the right to health among the fundamental social rights and verifies the effects of this classification. From the application of the logical rational model proposed by Alexy, it performs a structural analysis of article 196 of the Brazilian Constitution, identifying the legal relationship between the individual, the State and the object of the norm. It demonstrates the subjective dimension of the right to health. It locates elements that characterize the right to health not only as a social right, but as a subjective right, legally able to be protected by jurisdiction. It evaluates the State's position in the legal relationship identifying its duty to fulfill, through positive actions, the right to health. It addresses the normative effectiveness of the principles evaluating the possibility of balancing between the right to health and other principles, concluding that the right to health admits weighting only in relation to rights of the same degree of importance, such as the right to life. The second part is dedicated to the jurisdictional protection of the right to health through the civil process, understanding the fair civil process from the constitutional point of view and the role of jurisdictional protection in the realization of the substantive right. It studies the conception of fair process, understood as the process that turns to the realization of the substantive right through an effective, adequate, and timely jurisdictional protection. It analyzes the principle of adequacy of the process measuring the importance of adequate protection for the realization of the right to health. It identifies the compatibility of satisfactory protections with the effective realization of the right to health. It crosses the procedural technique of the early protection and its pertinence to the jurisdictional protection of the right to health. It concludes that the subjective dimension of the right to health determines its jurisdictional protection, regardless of balancing principles; among the available procedural techniques, the early protection stands out for its adequacy, by enhancing the effectiveness and timeliness of the jurisdictional protection of the right to health.en
