Sucessão hereditária e bens digitais : a (in)transmissibilidade de bens digitais via saisine

Abstract

Esta monografia é dedicada ao estudo da transmissão de bens digitais post mortem via saisine. Os bens digitais surgem na sociedade atual com a peculiaridade de potencialmente conterem aspectos econômicos e existenciais de seu titular. As transformações tecnológicas implicam a desmaterialização do patrimônio do indivíduo, culminando em acréscimo de valor financeiro aos bens digitais, ao mesmo tempo em que, progressivamente, inserem a identidade da pessoa no ambiente digital, necessitando da incidência da proteção dos direitos da personalidade. Com o evento morte, surge a controvérsia acerca do destino dos bens acumulados por um indivíduo no ambiente digital. Em uma pesquisa exploratória, e utilizando-se do método hipotético-dedutivo, parte-se da premissa da intransmissibilidade automática post mortem dos bens digitais aos herdeiros do de cujus. Para isso, no primeiro capítulo deste trabalho, apresenta-se os bens digitais e suas principais características. Após, expõe-se os aspectos da relação entre os bens digitais e os direitos da personalidade, sob o enfoque do evento morte. Por fim, no último capítulo, analisa-se o tema, de modo a averiguar a compatibilidade desse novo tipo de bem com o princípio da saisine, demonstrando-se os argumentos pelos quais se entende pela impossibilidade de sua aplicação.

The purpose of this dissertation is to study the post mortem transmission of digital assets under the principle of saisine. Digital assets emerge in the current society with the peculiarity of potentially containing economic and existential aspects. Technological transformations cause dematerialization of the individual property, therefore increasing the financial value of digital assets. Meanwhile, the concept of identity is progressively being inserted in the digital environment, which brings the need to protect the personality rights. Alongside death, the destiny of the individual’s assets accumulated in the digital environment is uncertain. Thereby, through an exploratory research, and by adopting the hypothetical-deductive method, this dissertation aims to test the hypothesis of the impossibility of automatic transmission of digital assets to the heirs after an individual’s death. The first chapter is intended to present the main aspects concerning digital assets. Subsequently, the relation between digital assets and personality rights is analyzed, under the approach of the consequences from the death. In the last chapter, the theme is examined in order to verify the compatibility of this new type of asset with the principle of saisine, being intended to present the arguments that stand for the impossibility of its application.
