dc.description.abstractO presente trabalho visa abordar o instituto do acesso à justiça. Os litígios provenientes do ambiente laboral são resolvidos perante a Justiça do Trabalho, tendo o instituto do acesso à justiça a finalidade de oportunizar que o demandante pobre litigue sem ter que suportar custas que prejudiquem o seu sustento e de sua família. Tendo em conta a relação assimétrica entre o empregador, detentor do capital e o empregado que necessita dos proventos de seu trabalho para sobreviver, o direito do trabalho é regido por princípios próprios. Neste trabalho serão estudados através de revisão bibliográfica os princípios da proteção, da informalidade, da celeridade e da aplicação da norma mais favorável ao trabalhador. Em 14 de julho de 2017 entrou em vigor a Lei nº 13.467/17, também conhecida como Reforma Trabalhista alterando dispositivos atinentes ao acesso à justiça, que serão estudados durante este trabalho. Também, serão analisados dados quantitativos acerca do ajuizamento de demandas trabalhistas com a finalidade de compreender se as alterações legislativas de fato prejudicaram o acesso à justiça. O Supremo Tribunal Federal julgou a constitucionalidade das alterações trazidas ao acesso à justiça trabalhista na Ação Direta de Inconstitucionalidade 5.766/DF. Assim, é necessário o confronto das alterações normativas com a decisão proferida pelo Supremo Tribunal Federal para compreensão do real impacto da Lei nº 13.467/17 no direito dos trabalhadores. O objetivo desta pesquisa, através de revisão bibliográfica e jurisprudencial é demonstrar a importância do acesso à justiça, quais as mudanças trazidas pela Lei nº 13.467/17 e auferir se estas alterações continuam vigentes após o julgamento da Ação Direta de Inconstitucionalidade 5.766/DF. Concluiu-se que o legislador buscava, com a edição da Lei nº 13.467/17, uma diminuição das ações ajuizadas perante a Justiça do Trabalho, o que de fato ocorreu. As alterações trazidas pela Reforma Trabalhista foram prejudiciais ao trabalhador pobre, pois o oneraram demasiadamente com o pagamento de honorários e, também, no caso de pagamento das custas processuais para ajuizamento de nova ação para o reclamante que não comparecer injustificadamente a audiência. O julgamento da Ação Direta de Inconstitucionalidade 5.766/DF recuperou, em parte, o direito dos trabalhadores pois julgou inconstitucional o pagamento das custas. Entretanto, o real impacto do julgamento desta ação no ajuizamento de demandas trabalhistas só será percebido ao longo do tempo, tendo em vista que a decisão foi proferida recentemente.pt_BR
dc.description.abstractThe present paper aims to approach the institute of access to justice. Disputes arising from the work environment are resolved before the Labor Court, and the institute of access to justice has the purpose of providing opportunities for the poor claimants to litigate without having to bear costs that harm their livelihood and their families. Bearing in mind the asymmetrical relationship between the employer, the holder of capital, and the employee who needs the earnings of his work to survive, Labor Law is governed by its principles. In this paper, the principles of protection, informality, celerity, and the application of the most favorable rule to the worker will be studied through a bibliographic review. On July 14, 2017, Law nº 13.467/17, also known as Labor Reform, came into force, changing provisions relating to access to justice; that will be studied during this work. Also, quantitative data about the filing of labor claims will be analyzed to understand whether the legislative changes hampered access to justice. The Federal Supreme Court judged the constitutionality of the changes made to the access of Labor Justice in the Direct Action of Unconstitutionality 5.766/DF, therefore it is necessary to compare the normative changes with the decision handed down by the Federal Supreme Court to understand the real impact of Law nº 13.467/ 17 in worker’s rights. The objective of this research, through a bibliographic and jurisprudential review, is to demonstrate the importance of access to justice and which are the changes brought by Law Nº 13.467/17. It was concluded that the legislator sought, with the enactment of Law nº 13.467/17, a decrease in the actions filed before the Labor Court, which eventually occurred. The changes brought by the Labor Reform were harmful to the poor worker as they burdened them too much with the payment of fees and, also, in the case of payment of procedural costs for filing a new lawsuit for the claimant who does not unjustifiably attend the hearing. The judgment of the Right Action of Unconstitutionality 5.766/DF partially recovered the rights of workers as it deemed the payment of costs unconstitutional. However, the real impact of the judgment of this action on the filing of labor claims will only be perceived over time, given that the decision was rendered recently.en
